LAWSUITS

CHS, Inc., Shipman, is suing John Kinser, Carlinville, for $21,363.82, plus a two percent per month service charge from July 31 to the date of judgment, claiming Kinser has failed to pay for agricultural goods and service purchased on credit between June 2015 and April 2016.

Meaghan O’Connell and Joshua Sarver is suing Ford Motor Co. for alleged breach of written and implied warranty on a 2013 Ford Fiesta the couple reportedly purchased through Landmark Ford in March 2013. The suit seeks an unspecified amount of damages for diminuation of value and/or the cost of repairs to fix the vehicle. The plaintiffs claim the company failed or was unable to fix several defects in the vehicle, for which they paid $16,200, despite being given multiple opportunities to make repairs. According to the suit, problems with the car include defects in the electrical system that monitors air pressure in the tires, defects in the transmission and defects in the body trim.

Linda and Brian Venrick have filed for forcible entry and detainer complaint against Tabitha Spain, Virden, seeking $1,400 in alleged back rent, plus possession of residential premises located in the 400 block of Birdsell Street in Virden.

Ruth E. Loveless has filed a forcible entry and detainer complaint against David Davis, Gillespie, seeking $420 in alleged back rent, plus possession of residential premises located in the 400 block of Montgomery Street in Gillespie.

CHS, Inc., Shipman, is suing Melvin E. Newstadt, III, West Alton, Mo., for $10,329.89, plus a two percent per month service charge from July 31 to the date of judgment, claiming Newstadt has failed to pay for agricultural goods and services purchased on credit in July 2015.

Town and Country Bank, Springfield, is suing Bryan A. and Jacqueline M. Motley, Palmyra, for $10,431.92, plus court costs, allegedly owed on a defaulted $20,663.02 promissory note executed in November 2015.

SMALL CLAIMS

Macoupin County Family Practice, Gillespie, is suing Scott R. and Julie Lafuria, Mount Olive, for $592.66, plus court costs, allegedly owed for medical services.

Carlinville Area Hospital is suing Judy Marie Baron, Virden, for $2,349.97, plus court costs, allegedly owed for medical services.

Carlinville Area Hospital is suing Rodney and Pamela J. Large, Greenfield, for $4,732, plus court costs, allegedly owed for medical services.

Consumer Collection Management is suing Eddie A. and Amy L. Heyen, Plainview, for $6,077.36, plus court costs, allegedly owed for medical services. The judgment sought includes $2,942.11 claimed by Macoupin Family Practice Centers, Gillespie; $2,629.25 claimed by Carlinville Area Hospital; and $506 claimed by Carlinville Healthcare.

Portfolio Recovery Associates, LLC, is suing Frank Shoemaker, Standard City, for $752.87, allegedly owed on a defaulted Synchrony Bank credit card account.

CHS, Inc., Shipman, is suing Ryan Hilmes, Carlyle, for $2,967.62, plus a two percent per month service charge from July 31 to the date of judgment, allegedly owed for agricultural goods and services purchased on credit.

CHS, Inc., Shipman, is suing Jernoam Gibson, Mount Olive, for $813.52, plus a two percent per month service charge from July 31 to the date of judgment, allegedly owed for agricultural goods and services purchased on credit.

CHS, Inc., Shipman, is suing Scott Kuhn, doing business as Scott Kuhn Trucking, Breese, for $2,187.68, plus a two percent per month service charge from July 31 to the date of judgment, allegedly owed for agricultural goods and services purchased on credit.

St. Louis Financial Group, LLC, is suing William Golden, Staunton, for $1,422, plus court costs and attorney fees, the plaintiff claims is owed on an $850 promissory note executed Nov. 6, 2015, with an interest rate of 69 percent.

Matthew and Katherine Logan, Brighton, is suing Nathan Walden and Kelsi Baker, Shipman, for $3,300, claiming the couple failed to disclose pre-existing defects relative to a property purchase. The judgment sough allegedly represents the amount the plaintiffs have spent and expect to spend to cure the alleged defects.

Carlinville Area Hospital is suing Brian Keith Fox, Girard, for $2,161.61, plus court costs, allegedly owed for medical services.

Portfolio Recovery Associates, LLC, is suing Alex G. Naylor, Bunker Hill, for $1,234.03, plus court costs, allegedly owed on a Citibank/Sears credit card account.

FELONIES

Wayne E. Lomelino, 36, Virden, is charged with seven counts of forgery and one count of theft. Lomelino is accused of forging seven checks totaling more than $4,000 made payable to himself and drawn on an account belonging to Lowder Construction Co. between June 23 and July 19. In addition, is accused of stealing more than $500 in cash from the company over a period of several weeks.

Daniel E. Richardson, 32, Carlinville, is charged with driving on a revoked driver’s license and resisting a peace officer in connection with an Aug. 14 incident in Girard. Richardson is accused of driving a 1991 Cadillac on South Street and Lincoln Street in Girard at a time when his license to drive was revoked. The charge was elevated to a felony due to previous convictions for the same offense on Richardson’s record from Aug. 23, 2011, in Macoupin County; Jan. 13, 2012, in St. Clair County; and Jan. 21, 2014, in Sangamon County. In addition, Richardson is accused of running away from the arresting officer at the time of the incident. Richardson also faces a charge of driving under the influence of alcohol in connection with the same incident, as well as a traffic charge for allegedly operating a vehicle with an expired registration.

Kyra I. Mostago, 33, Staunton, is charged with possession of methamphetamine in connection with an April 22 incident in Staunton during which she allegedly possessed less than five grams of the drug.

Timothy S. Abbott, 30, Palmyra, is charged with criminal damage to state-supported property in connection with a June 20 incident during which he allegedly caused more than $500 in damage to the hood of a Palmyra police car.

Jared E. Gibbs, 29, Palmyra, is charged with obstructing justice in connection with an Aug. 11 incident during which he allegedly provided false information to Palmyra Police Chief Wayman Meredith in an attempt to avoid prosecution. Gibbs allegedly told the Police Chief that his grandmother, not he, was the driver of a vehicle that crashed into two cars at the Smoky Jennings Chevrolet dealership in Palmyra.

MISDEMEANORS

Justin B. Hoyt, 39, Girard, is charged with domestic battery in connection with an Aug. 9 incident during which he allegedly poked a female member of his household in her chest with his finger and punched her in her mouth with his fist.

Kenneth C. Jones, 33, Virden, is charged with domestic battery in connection with an Aug. 12 incident during which he allegedly struck his ex-girlfriend in her face with his fist.

Dalton R. Shaw, 18, Hillsboro, is charged with battery in connection with an Aug. 14 incident during which he allegedly punched another individual in the face with his fist.

Gary W. Fuller, Sr., 45, Staunton, is charged with resisting a peace officer in connection with a July 9 incident.

Tory D. Holman, 45, Dorchester, is charged with battery in connection with a July 28 incident during which she allegedly pulled another female’s hair.

Benny E. Fish, 41, Medora, is charged with disorderly conduct in connection with a July 15 incident during which he allegedly threatened to kick down the door at the residence of a Medora female.

James Z. Marler, 22, Benld, is charged with theft of utility services in connection with a June 22 incident during which he allegedly was found to have illegally diverted City of Benld water services.

Niki M. Chapman, 23, Carlinville, is charged with battery in connection with a July 18 incident in Carlinville during which she allegedly punched a male victim on the left side of his face with her fist.

Eric M. Streeb, 28, Staunton, is charged with battery and criminal trespass to property in connection with a July 19 incident.

Deborah A. Benton-Atkins, 29, Brighton, is charged with battery in connection with a July 17 incident in Brighton during which she allegedly struck a male victim on the left side of his face with her hand.

Stephanie R. Cochran, 33, Girard, is charged with domestic battery in connection with an Aug. 16 incident in Girard during which she allegedly struck a male victim in his stomach with a baseball bat.

Daniel B. Grimmett, 32, Virden, is charged with violating a no-contact/no stalking order in connection with an Aug. 11 incident during which he allegedly came within 500 feet of a person subject to a court-imposed no-contact order issued Aug. 1.

Myron J. Marshall, 34, Medora, is charged with domestic battery and with violating an order of protection in connection with an Aug. 16 in Shipman incident during which went to the residence of a Shipman woman subject to a July 21 order of protection against him, pulled his ex-girlfriend’s hair and smacked her in her face with in hand.

Trevor J. Hoover, 44, Bunker Hill, is charged with domestic battery in connection with an Aug. 17 incident during which he allegedly grabbed his wife and threw her to the ground.

Brandon D. Butler, 29, Bethalto, is charged with domestic battery in connection with an Aug. 17 incident during which he allegedly shoved his girlfriend in her chest with his hands.

James R. Varble, 46, Hettick, is charged with violating an order of protection in connection with an Aug. 16 incident during which he allegedly induced a third party to contact a female subject to an Aug. 8 order of protection against him on Faceback on his behalf.

Dakota J. Mehochka, 18, Gillespie, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with an Aug. 2 incident in Gillespie.

Jeremy Dean Uchtman, 18, Gillespie, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with an Aug. 2 incident in Gillespie.

TRAFFIC

Julia M. Tracy, 58, Godfrey, is charged with driving under the influence of alcohol in connection with an Aug. 5 incident on Shipman Road. Tracy also faces a traffic charge for allegedly failing to reduce the speed of her vehicle to avoid an accident.

Tina M. Youtz, 39, Nokomis, is charged with two counts of driving under the influence of alcohol in connection with an Aug. 13 incident on Montgomery Street at Pine Street in Gillespie.

Jeffrey S. Swan, 36, Carlinville, is charged with two counts of driving under the influence of alcohol in connection with an Aug. 13 incident on Hoehn Street at Broad Street in Carlinville. Swan also faces a traffic charge for alleged improper lane usage.

Ross D. Shotts, 29, Carlinville, is charged with two counts of driving under the influence of alcohol in connection with an Aug. 13 incident on North West Street at West First North Street in Carlinville. In addition, he faces a traffic charge for allegedly failing to operate headlights while using windshield wipers.

Kirklund A. Davis, 18, Gillespie, is charged with driving under the influence of alcohol in connection with an Aug. 14 incident on Warren Street at Union Street in Bunker Hill. He also faces a traffic charge for allegedly squealing or screeching of tires.

James A. Iler, 42, Brighton, is charged with two counts of driving under the influence of alcohol in connection with an Aug. 19 incident on Olive Street at North Street in Brighton. In addition, Iler was charged with driving on a revoked driver’s license.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
