Benld Council approves appropriation, accepts Motor Fuel Tax bid for road oil

During a relatively brief meeting Monday night, the Benld City Council unanimously approved a $1.2 million appropriation ordinance for the fiscal year that began May 1 and will end April 30 next year. The council also discussed the status of efforts to collect household income data in specific parts of the city that ultimately will determine the municipality’s eligibility for a federal Community Assistance and Development Program (CDAP) grant to improve portions of the city’s sewer system.

Finance Committee Chair Ald. Peyton Bernot said the draft appropriation ordinance had been on public view for a month and was unchanged from when he gave a detailed presentation of the document last month. In total, the ordinance authorizes expenditures of $1,245.709 for the fiscal year, compare with  last year’s appropriation of $1,171,337. Bernot said one reason for the increase is the inclusion of $200,000 in anticipated expenditures for the proposed sewer project if the CDAP grant application is approved.

Broken down by specific funds, the new appropriation authorizes expenditures of $304,809 from the Sewer Fund, including the $200,000 in projected expenditures for sewer improvements. It authorizes $284,550 in expenditures from the Water Fund, compared with $304,741 last year; $111,147 for Trash, compared with $101,400 last year; $59,679 for Administration, compared with $45,236 last year; $65,826 for City Property, compared with $62,868 last year; $94,931 for Maintenance, compared with $89,928 last year; $258,292 for Police, compared with $265,931 last year; $1,900 for Unemployment Insurance, compared with $600 last year; and $4,474 for the Public Library.

Appropriations for some funds are either unchanged or reduced from a year ago, including $10,000 for Legal Fees, down from $19,000 last year; $1,201 for Parks, down from $7,000 last year; $1,350 for Cemetery operating expenses, down from $1,400 last year; and $1,260 for the Municipal Band, which is unchanged from last year.

The appropriation ordinance for the past fiscal year was amended in April, cutting $21,000 in Proprietary Fund expenditures, and adding $14,000 and $896 to expenditures from the Motor Fuel Tax Fund and General Fund, respectively.

Bernot, the city will anticipate a deficit of $199,703 in the General Fund due to the anticipated transfer of $200,000 to the Sewer Fund to subsidize the proposed sewer improvement project. The transfer will leave the Atrazine account with a balance of $46,007 at the end of the fiscal year and, because of a $299,658 beginning balance, the General Fund is expected to end the year with a $300,955 positive balance at the end of the fiscal year.

Projected expenditures from the Proprietary Fund total $700,506, including the $200,000 for the sewer improvement project which is contingent upon the CDAP grant being awarded. Projected income for the Proprietary Fund, is projected at $733,894, which includes the tentative transfer of $200,000 from the Atrazine account.

In a somewhat related matter, the council heard a report from City Clerk Terri Koyne regarding the status of a survey to determine household income levels in the areas affected by the proposed sewer improvement project. The city is hoping to qualify for a CDAP grant to subsidize 75 percent of a proposed $600,000 sewer improvement project. If approved, the project will include upgrades to renovations to sanitary sewer lift stations on Hickory and Chestnut streets, replacement of two main sewer lines on the city’s northeast side and improvements to approximately 20 manholes. To qualify for the grant, however, the city must be able to demonstrate that more than half of the households benefiting from the project are low or moderate income households.

The city recently began mailing income surveys in the affected areas. Koyne said 151 of nearly 280 mailed surveys have been returned. Based on the returned surveys, 49 percent of the affected households are low or moderate income households.

“We are right on the line,” Koyne said. “We need around 51 percent.”

She said she has a list of households that have not yet returned surveys and suggested that city officials concentrate on households located on the northeast side of the city where the largest number of affected households are located.

“We need 59 more surveys back,” she reported.

There are concerns that collecting additional surveys, however, may not change the ratio of low and moderate income households to upper income households.

“We have a lot of owned property; it’s not rental property,” she said. If the number of qualifying households is marginal, Koyne said it could affect the city’s prospects of securing the grant. “If we’re neck and neck with another community,” she said, a community with a larger percentage of low and moderate income households could win a grant at the expense of Benld.

Mayor Jim Kelly noted that another qualification for securing the grant is having engineering work done in advance. He indicated the city needs to determine whether or not the city qualifies for the grant before committing money for engineering, estimated to run about $20,000.

LIBRARY LAWSUIT

City Attorney Rick Verticchio reported to the council that a $10,000 settlement offered by the manufacturer of flooring material that failed after being installed at the Benld City Library has been withdrawn. Verticchio said it appears the offer, which was to have been supplemented with a $2,500 payment from Quality Flooring, has been withdrawn because Base King, the manufacturer, is planning to file for bankruptcy protection.

“The litigation has not gone as well as we had expected,” Verticchio said. “Base King ran into financial difficulties and their attorney is withdrawing the offer.”

He said he has asked the court to schedule a status hearing the first week in July. If Base King does file for bankruptcy, the city will have no option for relief other than the settlement offer from Quality Flooring.

“We could proceed and get a judgment, but we wouldn’t be able to collect it,” he said. “All we’re left with is Quality Flooring. “We feel sorry for Quality Flooring because all Quality Flooring did was buy a product from a manufacturer.”

Verticchio also reported the court has granted permission for the city to seek bids to demolish two derelict properties on Rose Street and that he expects to get court approval to raze another building in the 400 block Main Street next month.

Responding to a question from Ald. Jim Tilashalski, Verticchio said that while the city is authorized to demolish the properties, it is not authorized to sell them. Tilashalski had wanted to know if the city could sell them to a buyer with an agreement the new owner would tear down the nuisance structures.

“The problem you run into is you’d have to get permission from the court,” Verticchio said. “We haven’t acquired the property. We’ve only been given permission to demolish it. We can’t sell it because we don’t own it.” He said, however, the city could make an advance agreement to sell the property for the cost of demolition, contingent upon the city acquiring it.

A fourth nuisance property, known as the Dugan property, has been acquired by the county for back taxes and resold to a buyer from Troy, according to Verticchio.

“That’s actually a good thing for us,” Verticchio said, noting that the new owners are now responsible for the cost of abating the nuisance.

On a motion by Bernot, seconded by Tilashalski, the council unanimously voted to authorize Verticchio to file a foreclosure against the Tennikat property, which the city has been mowing for several years, if no payment is received toward the city’s mowing lien by July.

MOTOR FUEL TAX BIDS

On the recommendation of Doug Ratterman of Henry, Meisenheimer and Gende Engineers, the council accepted a bid of $1.1410 per gallon from Mike Madge Trucking, Highland, to supply road oil for this year’s Motor Fuel Tax street maintenance program. Ratterman said Maedge was the lowest of three contractors submitting bids. Based on the streets identified for resurfacing this year, Ratterman said the projected cost for road oil is $13,239.45 to come from the city’s Motor Fuel Tax Fund.

“We got better prices than originally estimated,” Ratterman said, noting that the city could conceivably add some streets to its list of streets scheduled for resurfacing.

CEILING COLLAPSE

Ald. Brian Frensko, City Property Chair, reported that the ceiling in the Nutrition Center, adjacent to the Civic Center, recently collapsed. He said the city’s insurer has been notified and he is in the process of seeking bids to repair the damage. In the meantime, Illinois Valley Economic Development Corporation has removed food preparation and serving equipment used for a senior citizens nutrition program with the expectation of moving back when the facility is again available.

“I think it’s going to be pretty expensive to repair,” Frensko said.

In a related matter, the council again tabled action on a bid to replace doors at the Civic Center after Ald. Tilashalski questioned the need for the number of doors in the facility. The Civic Center can be entered from Central Avenue or through City Hall, and it has three additional exits, one of which opens into a narrow space between the Civic Center and the Nutrition. Tilashalski questioned whether all three exit doors are needed to meet safety requirements.

Ald. Bernot noted that the east side exit opens into a space that is only about three feet wide and would be of questionable utility in evacuating the building in the event of an emergency.

Frensko agreed to look into fire code requirements and return with a recommendation to the council.
