Benld Council authorizes yoga classes at Civic Center

The Benld City Council on Monday night authorized a local yoga instructor to use the Civic Center to offer community yoga classes, voted to return a $900 donation to the donor, and voted dedicate upward of $193,000 in American Rescue Plan Act (ARPA) funds for water system maintenance and improvements.

Council members voted 5-1 to allow Candi Katchmar to use the Civic Center for weekly yoga classes on a three-month trial basis. The city is expected to revisit the issue at the end of the three-month trial period, contingent upon Katchmar providing proof of liability insurance and posting a $25 cleaning deposit. Ald. John Balzraine cast the sole negative vote against the measure.

The vote followed a brief presentation by Katchmar and several questions from aldermen. Katchmar, a certified yoga instructor, said she plans to offer weekly one-hour sessions for any member of the community who wishes to attend. Responding to questions from aldermen, Katchmar said she has liability insurance and will provide a copy of her policy to the City Clerk.

Participants will not pay a set fee but will instead make a donation in an amount that is comfortable for them, according to Katchmar. She said she plans to pocket no more than $50 per session to cover her expenses, including insurance. A minimum of 20 percent of the proceeds will be donated to Adopt-A-Pet, Katchmar said.

Ald. Mickey Robinson asked if Katchmar had contacted Adopt-A-Pet and whether or not Adopt-A-Pet had endorsed her plan. “I have not,” Katchmar said, adding Adopt-A-Pet would accept her donation.

With participants from Benld, Gillespie and surrounding communities, Katchmar said she expects a minimum of 10 persons to attend her sessions. When weather allows, she said she would conduct the classes under the Benld Park pavilion.

According to Katchmar, there is a growing interest in yoga but COVID restrictions have made it difficult to find suitable venues to offer classes. She said local school gymnasiums are frequently busy and unavailable during the times when yoga classes typically are offered.

“To be clear, you are asking us to donate the building?” Mayor Jim Kelly asked. Kelly said he had “no problem” with offering the facility but worried about the cleaning deposit. Katchmar said she would be personally responsible for cleaning up the facility after each session, plus she noted there should not be a need for extensive clean-up after an activity like yoga. City Clerk Terri Koyne suggested having Katchmar pay a $25 cleaning deposit to be held by the city.

Before voting against the measure, Balzraine commented that the city’s past practice had been to require rental payments for any Civic Center users other than non-profits such as Boy Scouts or Girl Scouts. “This isn’t either of those,” he said.

The remaining five aldermen voted in favor of Ald. Dustin Fletcher’s motion to allow the use of the Civic Center for a trial period of three months, contingent upon Katchmar providing proof of insurance and posting a $25 cleaning deposit.

DONATION RETURNED TO BERNOT

After a lengthy, sometimes terse, discussion, the council voted 5-1 to return a $900 donation to former alderman Peyton Bernot. Bernot made the donation to the city last October with the stipulation that it be used to plant trees on Central Avenue in downtown Benld. Mayor Kelly told the council Monday night he had received an email from Bernot questioning why no trees have been planted at this time.

“He interpreted that we had to act by spring,” Kelly said. “There’s nothing like that in the minutes or anywhere else.”

Kelly said the city is in line to receive a grant from the Illinois Department of Transportation to replace sidewalks on Central Avenue. Guidelines for the grant include making the new sidewalks a minimum of 43 inches wide, plus provisions for accessibility for disabled persons. Those provisions, he said, will preclude planting trees on Central Avenue.

“So what’s your pleasure?” Kelly asked. “Do you want to plant trees and then have to take them out if we get the grant, or do you want to give him his money back.”

Ald. Jerry Saracco said trees remaining on Central Avenue are problematic because they’ve been allowed to grow into overhead electric lines. The trees interfere during the holidays, he said, when the Italian-American Club puts up Christmas decorations.

“It’s more than just planting trees,” Saracco said. “We have to maintain them. Personally, I don’t think they belong on Main Street because they’re in the way.”

Ald. Jim Tilashalski, who previously has advocated planting trees and taking a more conservative approach to removing trees, used the issue to segue into a larger discussion about trees in the city. Tilashalski said he had offered to pay for trees out of his pocket and he said he objected to removing specific trees without approval from the full council.

“I don’t know that we can wait until a meeting of the council to decide to cut trees when we they pose a danger,” Mayor Kelly said. “We have a Maintenance Department and a committee, and if they need to make a decision to cut a tree, they need to be able to do that.”

Ald. Dustin Fletcher agreed trees can be a part of city beautification but when they aren’t maintained “a tree can be an eyesore.”

Near the end of the discussion, Ald. Mickey Robinson suggested tabling the Bernot issue and referring it to the committee.

“No,” Kelly responded. “We want to settle this tonight. I don’t want to be getting any more emails like this.”

Tilashalski commented that “$900 is not going to get you a lot of trees.”

With Ald. Lance Cooper voting “no,” the council voted 5-1 to approve Ald. Balzraine’s motion to return Bernot’s donation to him, along with a note thanking him for his contribution.

NUISANCE PROPERTIES

Following a 15-minute executive session, the council voted to declare property at 223 East Central Avenue as a nuisance property. The measure gives owners Phil Willis and Cheyenne Bunata, both of Glen Carbon, 30 days to correct nuisance issues at the location. The two-story brick building formerly was a bank.

City Attorney Rick Verticchio said the building has become a safety concern because “there are sheets of sheet metal blowing off the building.”

The council also authorized Verticchio to initiate court proceedings against Gary Cunningham, owner of a property at 400 South Sixth Street. Cunningham had previously been given 30 days to clean up the property, but Kelly said he apparently has cleaned up junk on the property only to bring in more junk after the clean-up.

“We have an ordinance against running a junkyard in the city,” Kelly reminded Verticchio.

ARAP FUNDS

After a brief discussion, the council voted unanimously to dedicate $193,860.17 in American Rescue Plan funds on maintenance and improvements for the city’s water system. The city has already received one payment representing 50 percent of the funds due to the municipality, and expects to receive a second payment soon. While the city has until 2024 to spend the funds, the program requires the city to advise the federal government by the end of October of how it intends to use the funds.

Mayor Kelly said the water tower is due for cleaning and painting, and the city needs to buy a new hand-held meter reading device. The remaining funds, he said, can be spent on new water meters.

“I think we can easily justify spending that money on our water system,” he said.

POSSIBLE REDISTRICTING

On the recommendation of the Ordinance and Judicial Committee, City Attorney Verticchio said he would look into the need for possibly redrawing ward boundaries. Mayor Kelly said the results of the 2020 Census, recently received by the city, show the population declined to 1,465 since the last count. Committee Chair Tilashalski said the city could retain existing ward boundaries if there is no more than five percent variation in the number of people living in each ward.

Verticchio said he will try to have a new map ready before the next meeting of the council.

Tilashalski’s suggestion to research a controversial “push tax” initiative was referred to committee. The tax has been approved in some northern Illinois municipalities but so far has not caught the attention of downstate municipalities. In essence, the concept is to charge a one-cent tax for each “push” registered on electronic gaming machines.

Verticchio said Bunker Hill recently rejected a proposal to implement a push tax. Among the legal issues, he said, is determining who is responsible for paying the tax—the machine owner or the person playing the machine. Some communities have rejected the tax on the theory it could reduce playership if it costs consumers more to play machines in communities that have the tax.

“I suspect it will be challenged in court,” Tilashalski admitted. He said one the questions likely to come up will be whether or not machines already licensed will be grandfathered to be exempt from the tax.

MAINTENANCE DEPARTMENT OPENING

On a motion by Saracco, seconded by Balzraine, the council voted unanimously to advertise for applicants for a third position within the Maintenance Department. The new employee will replace former Police Chief Jim Zirkelbach, who was asked to resign last month following an extended medical leave.

“Will we have enough work going into the winter for a third employee?” Tilashalski asked.

Kelly noted there is fall maintenance work remaining to be done at the sewer lagoon and other facilities before winter sets in.

SECURITY CAMERAS

On a motion by Saracco, seconded by Cooper, the council voted unanimously to purchase security camera systems for City Hall and the Maintenance Building from Auto Sound & Security, Staunton, at a cost of $8,120.

The city will spend $5,045 for exterior and interior cameras at City Hall. The interior cameras will replace an existing system and will be compatible with exterior camera systems at City Hall and the Maintenance Building. The remaining $3,075 will cover the cost of cameras at the Maintenance Building.

INSURANCE RENEWAL

The council voted unanimously to renew a liability insurance policy with the Illinois Municipal League at an annual cost of $20,750, which includes $250 in annual dues for the organization. The policy is a pool plan that shares risk with other member municipalities to reduce costs. Kelly said the cost is an increase of $300 over last year’s premium. The city will take advantage of a one percent discount by paying the premium by Nov., 19.
