LAWSUITS

A Carlinville nursing home is the target of a wrongful death lawsuit seeking a judgment in excess of $50,000. Bud Johnson, Carlinville, as executor of the Estate of Rosalie Johnson, is suing Covenant Care Midwest, Inc., doing business as Friendship Skilled Nursing and Rehabilitation, Carlinville, claiming that negligence on the part of the nursing home caused Johnson’s death in October 2014. According to the suit, family members transported Johnson by family vehicle from the nursing home to Carlinville Area Hospital on Oct. 14, 2014, where she was diagnosed with acute renal deficiency, hypovolemic shock, hyperkalemia, urosepsis and septic shock due to dehydration. Johnson was transferred to St. John’s hospital, Springfield, where she died later on Oct. 14, 2014, according to the suit. According to an obituary published at the time of her death, Johnson was 82 years old. The two-count lawsuit alleges the nursing home violated provisions of the Nursing Home Care Act and caused Johnson’s wrongful death. The suit claims the nursing home was negligent in that it allegedly neglected Johnson, failed to notify her physician of significant changes in her condition, failed to provide adequate and properly supervised nursing care for Johnson, failed to administer procedures ordered by her physician, and failed to make objective observations of Johnson to analyze and determine the care required and the need for further medical evaluation and treatment. The suit alleges Johnson suffered pain, anguish and death due to the alleged negligence and that her family became responsible for large sums of money for her medical care and hospitalization for which they seek a judgment in excess of $50,000.

A Carlinville man and his wife are being sued by the man’s sister for damages in excess of $50,000 in a lawsuit transferred to Macoupin County Circuit Court from Sangamon County upon a motion by defendants. Jamie McLaughlin, Chicago, is suing James C. McLaughlin and his wife, Kelly M. McLaughlin, claiming the couple physically battered her and made comments to her designed to cause her emotional duress. The suit refers specifically to an April 11, 2015, incident at the home of James and Jamie’s parents home in Carlinville during which James allegedly “shoved” the defendant and Kelly allegedly bumped her chest against the plaintiff’s chest while knowing the plaintiff to be subject to back problems. Two additional counts allege the couple screamed and yelled at the plaintiff at various times between December 2014 and April 2015. The suit alleges James McLaughlin yelled at Jamie McLaughlin over the phone on Dec. 27, 2014, and made comments to her on March 16, 2015, including a description of how he “beat down prisoners” at his job at the Macoupin County Jail and made a disparaging remark about Jamie’s friend, with the intent to upset her while their father was undergoing surgery. The suit further alleges James McLaughlin refused to allow the plaintiff to see her niece in order to giver the girl a gift. The suit further alleges that Kelly McLaughlin also screamed on the plaintiff on Dec. 27, 2014, and accused the plaintiff of taking her daughter without permission when the defendant had given permission for her to pick up the girl. Jamie McLaughlin claims to have injured substantial medical bills, including bills for psychiatric treatment, as a result of the incidents.

State Sen. William S. “Sam” McCann is the target of an $11,461.33 lawsuit filed by Portfolio Recovery Associates, LLC. The suit seeks recovery of an allegedly defaulted Capital One credit card account, plus court costs.

Pekin Insurance Group is suing S & S Complete Concrete, LLC, Gillespie, for $24,231.15, plus court costs, allegedly owed for insurance premiums.

Midland Funding, LLC, is suing Alex Radae, Bunker Hill, for $16,826.66, plus court costs, allegedly owed on a defaulted Citibank credit card account.

First MidAmerica Credit Union is suing Kimberly A. McKinney, Virden, for $10,189.91, plus interest at a rate of 9.54 percent and court costs, allegedly owed on a defaulted auto loan executed in December 2014 for the purchase of a 2014 Dodge Journey. According to the suit, the vehicle was repossessed and sold for $13,589 in 2015, leaving the $10,189.91 balance on the loan.

Sue Pirok, Worden, has filed a forcible entry and detainer complaint against Monica Link, Staunton, seeking $900 in alleged back rent, plus court costs and possession of residential premises located in the 800 block of Page Street in Staunton.

Diana Wise, O’Fallon, is suing Dave Brown, Standard City, and Richard Bushue, Carlinville, for unspecified damages in excess of $10,000, plus interest, court costs and attorney fees, resulting from a Dec. 19, 2015, traffic accident in Carlinville. Wise claims to have  sustained damages when a Toyota truck driven by Bushue and owned by Brown rear-ended the vehicle she was driving on West Main Street at a time when neither of the defendants had auto insurance. The suit alleges Bushue was negligent in that he allegedly failed to operate the truck in a safe and reasonable manner, failed to keep a proper lookout for other vehicles, failed to stop for vehicles on the roadway and failed to operate the vehicle in compliance with state and local traffic laws. The suit also alleges Brown was negligent in entrusting Bushue to operate the vehicle, knowing that Bushue had been cited for operating an uninsured motor vehicle 10 times over the previous decade. As a result of the accident, Wise claims to have sustained bodily  injuries and damage to the vehicle she was driving for which she seeks a judgment of more than $10,000 not to exceed $50,000.

Portfolio Recovery Associates, LLC, is suing Eberle Darnell, Carlinville, for $2,670.23, plus court costs, that Darnell allegedly owes on a defaulted Synchrony Bank credit card account.

Capital One Bank is suing Daniel Randle, Staunton, for $2,643.99, plus court costs, that the defendant allegedly owes on a defaulted credit card account.

Springleaf Financial Services of Illinois, Springfield, is suing Robyn A. Roberts and Brian S. Schmidt, both of Staunton, for $4,896.62, plus court costs, allegedly owed on a defaulted line of credit.

Cavalry SPV I, LLC, is suing Kari Moore, Staunton, for $4,778.37, plus court costs, allegedly owed on a defaulted Synchrony Bank credit card account.

Cavalry SPV I, LLC, is suing Janet Meininger, Plainview, for $2,714.90, plus court costs, allegedly owed on a defaulted Citibank credit card account.

Midland Funding, LLC., is suing Dani Olson, Virden, for $1,196.89, plus court costs, allegedly owed on a defaulted Citibank credit card account.

Midland Funding, LLC,  is suing Sean Rees, Carlinville, for $1,826.77, plus court costs, allegedly owed on a Citibank credit card account.

First National Bank in Staunton is suing Justin M. Thornhill, Gillespie, for $2,852.06, plus court costs and attorney fees, allegedly owed on a defaulted promissory note executed in February 2012 for $2,533.86.

Resurgence Capital, LLC, is suing Margaret J. Walls, also known as Margaret Trew, Girard, for $2,636.53, plus court costs and $350 in attorney fees, allegedly owed on a defaulted retail installment contract.

FELONIES

Bonnie G. Madison, 35, Carlinville, is charged with possession of less than five grams of a substance containing methamphetamine in connection with a Feb. 14 incident in Macoupin County.

Steven K. McDaniels, 29, Carlinville, is charged with possession of less than five grams of a substance containing methamphetamine in connection with a Feb. 13 incident in Macoupin County.

Brian E. Hiler, 52, Nilwood, is charged with possession of less than five grams of a substance containing methamphetamine in connection with a Feb. 17 incident in Macoupin County.

Rita M. Skipton, 47, Nilwood, is charged with possession of less than five grams of a substance containing methamphetamine in connection with a Feb. 17 incident in Macoupin County.

Paul M. Golden, 37, Carlinville, is charged with retail theft in connection with a Feb. 17 incident during which he allegedly shop-lifted paint and dishwasher cleaner with a total value of less than $300 from the Carlinville Walmart store. The charge was elevated to a felony due to a previous conviction for the same offense on Golden’s record from 2014 in Sangamon County.

Darval NMI Lewis, 26, St. Louis, Mo., is charged with possession of a controlled substance in connection with an Oct. 13, 2015 incident during which he allegedly possessed less than 15 grams of a substance containing heroin.

MISDEMEANORS

Michael T. Skrele, 48, Waverly, is charged with domestic battery in connection with a Feb. 12 incident in Girard during which he allegedly grabbed his girlfriend by her face and pushing her to the ground.

Justin P. Krueger, 27, Staunton, is charged with aggravated assault in connection with a Feb. 13 incident during which he allegedly threw a cell phone at a Staunton Police officer, knowing him to be a peace officer engaged in the official execution of his duties.

Kyra I. Mostajo, 33, Staunton, is charged with domestic battery in connection with a Feb. 14 incident in Staunton during which she allegedly struck her boyfriend in his face with her fist.

Chris H. Bruntjen, 38, Litchfield, is charged with obstructing identification in connection with a Feb. 17 incident during which he allegedly provided a false name to an Illinois State Police trooper who had lawfully detained Bruntjen.

In separate complaints, several area residents are charged with deceptive practice for allegedly writing checks to local businesses while knowing the drafts would not be honored by their banks. Those charged include: Kyle J. Lancaster, 25, Gillespie, accused of writing a bad check for $63.07 on Sept. 20, 2015, to TJ’s, Benld; Candace A. Waugh, 33, Gillespie, accused of writing a bad check for $3.90 on Dec. 29, 2015, to Gillespie Family Practice; Kayla J. Shaw, 27, Mount Olive, accused of writing a bad check for $65.13 on Nov. 14, 2015, to Mt. Olive Enterprises, LLC; Racinda M. Whitworth, 52, Plainview, accused of writing a bad check for $28.32 on Nov. 21, 2015, to Bunker Hill Short Stop; Sharon L. Clagg, 56, Jerseyville, accused of writing a bad check for $23.46 on Nov. 9, 2015, to Joseph Boente & Sons, Carlinville; Donna L. Rebbe, 49, Carlinville, accused of writing a bad check for $176.05 on Nov. 27, 2015, to Macoupin County Veterinary Clinic, Carlinville; Polly J. Gai, 59, Staunton, accused of writing a bad check for $68.90 on Dec. 18, 2015, to Madison Communications; Andrew J. Hopper, 25, Benld, accused of writing a bad checks for $1,052.22 on Sept. 2, 2015, and $322.01 on Sept. 8, 2015, to Community Wholesale Tire, Hazelwood, Mo.; Robyn D. Roberts, 33, Greenfield, accused of writing bad checks for $139.17 on Nov. 17, 2015, and $83 on Dec. 8, 2015, to Joseph Boente & Sons, Carlinville; Christopher D. Lewis, 38, White Hall, accused of writing a bad check for $40 on Dec. 23, 2015, to Joseph Boente & Sons, Carlinville; and Joshua D. Burney, 25, Bunker Hill, accused of writing a bad check for $65 on Dec. 2, 2015, to Bunker Hill Short Stop.

Kyra I. Mostajo, 33, Staunton, is charged with aggravated assault in connection with a Feb. 9 incident during which she allegedly swerved the vehicle she was driving toward a bicyclists on Mill Street in Staunton, placing the cyclist in reasonable apprehension of receiving a battery.

Tesa L. Williams, 20, Staunton, is charged with domestic battery in connection with a Feb. 21 incident during which she allegedly struck her boyfriend in his neck with a cigarette rolling machine.

TRAFFIC

Daniel Butler, 48, Shipman, is charged with two counts of driving under the influence of alcohol in connection with a Feb. 20 incident. Butler also faces traffic charges for allegedly driving on revoked driver’s license and alleged improper lane usage.

Jarrod M. Powell, 32, Girard, is charged with driving under the influence of alcohol in connection with a Feb. 20 incident. In addition, Powell faces a traffic charge for alleged improper lane usage.

Melanie B. Root, 46, Gillespie, is charged with two counts of driving under the influence of alcohol in connection with a Feb. 21 incident. Root also faces traffic charges for failing to reduce speed to avoid an accident and illegal transportation of alcohol by a driver.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
