LAWSUITS

CHS, Inc., Shipman, is suing Richard W. Lehn, Keyseport, for $74,959.66, plus service fees of two percent per month until the time of judgment, along with attorney fees and court costs. The plaintiff alleges the amount is owed for agricultural goods and services purchased by the defendant on credit between May and December 2015.

Michael Cummings, Staunton, is suing Scott Ventimiglia, Staunton, for unspecified damages in excess of $50,000 for “damages of a personal and pecuniary nature allegedly resulting from an Aug. 1, 2015, traffic accident in Staunton. According to the suit, Cummings was riding a motorcycle west on West Peal Street, when an eastbound motor vehicle operated by Ventimigalia attempted to make a left turn near the Hibbard Street intersection. The suit claims Ventimiglia was negligent in failing to keep a proper lookout of Cummings’ vehicle, failing to reduce the speed of his vehicle to avoid the accident, driving too fast for conditions and failing to give an audible warning by sounding his vehicle’s horn.

Jeffrey Morris, Carlinville, is suing Larry Baker, Carlinville, for unspecified damages in excess of $50,000 for injuries he allegedly sustained in a Jan. 22, 2015, traffic accident in Carlinville. According to the suit, Morris was the driver of an eastbound motor vehicle that was struck from the rear by an eastbound vehicle driven by Baker on East First South Street. The suit alleges Baker was negligent in failing to apply the brakes of his vehicle to avoid the collision, failing to keep a proper lookout for other vehicles, failing to keep his vehicle under proper control and driving too fast for prevailing conditions. Morris seeks a judgment to compensate him for alleged injuries to his eyes and other parts of his body, pain and anguish, medical expenses and loss of income.

Adam S. Norman has filed a forcible entry and detainer complaint against Daniel Richardson, Virden, seeking $1,650 in alleged back rent, plus an unspecified amount for damages, along with court costs and possession of residential premises located in the 800 block of North Springfield Street in Virden.

John and Sharon Paoni have filed a forcible entry and detainer complaint against Vanja Selmic and Nedir Osmanov, Staunton, seeking $700 in alleged back rent, plus court costs, attorney fees and possession of residential premises located in the 800 block of Hibbard Street in Staunton.

Macoupin County Housing Authority has filed a forcible entry and detainer complaint against Debra Schlechte, Carlinville, seeking possession of an MCHA apartment located in the 700 block of Dearbee Drive, Carlinville. The suit alleges Schlechte violated terms of her lease by allowing dogs to run at large in the housing development, failing multiple housekeeping inspections, failing to have water service in her own name and failing to pay rent in a timely manner. In addition to possession of the property, the complaint seeks monetary damages for $41.41 allegedly owed for rent for the month of August, along with attorney fees and court costs.

Donna Beeman has filed a forcible entry and detainer complaint against Samantha Higgins Lackey and Brandon Lackey, Virden, seeking $395 in alleged unpaid rent, along with possession of residential premises located in the 900 block of North Grove Street in Virden, an unspecified amount for damages, court costs and cleaning costs.

Ford Motor Credit Co., LLC, is suing Raymond M. Stillwell, Alton, for $12,325.53 allegedly owed on a defaulted auto loan, along with interest, attorney fees and court costs. The plaintiff allegedly financed $37,000 in 2013 for the defendant to purchase a 2013 Ford Mustang.

SMALL CLAIMS

Commerce Bank is suing James M. Brawner, Gillespie, for $916.05, plus interest of nine percent and court costs, that the plaintiff claims is owed on a defaulted credit card account.

Kenneth E. Clark, Brighton, is suing Jeff and Karen Heineman, Brighton, on behalf of the Alpine Acres Homeowners Association, Inc., seeking a judgment of $1,022.23 that the Heinemans allegedly owe for maintaining Alpine Acres Lane, a private road maintained at the expense of Homeowners Association members who reside on the road. According to the suit, the Heinemans maintain a residence in the 4000 block of Alpine Acres Lane.

Portfolio Recovery Associates, LLC, is suing Jessica Nash, Carlinville, for $1,331.26, plus court costs, that Nash allegedly owed on a defaulted Gordman’s credit card account.

Portfolio Recovery Associates, LLC, is suing Rhonda J. Harris, Bunker Hill, for $5,354.19, plus court costs, that Harris allegedly owes on a defaulted Sears credit card account.

Portfolio Recovery Associates, LLC, is suing Crystal Beasley, Shipman, for 703.51, plus court costs, that Beasley allegedly owes on a defaulted Maurices credit card account.

FELONIES

Paisley A. Ward, 22, Carlinville, is charged with driving on a suspended license in connection with an Aug. 17 incident on West Main Street at Locust Street in Carlinville during which he allegedly operated a 2005 Chevrolet vehicle while is driver’s license was suspend. The charge was elevated to a felony due to a previous conviction for the same offense on Ward’s record from March 12, 2015, in Madison County. In addition, Ward was issued traffic citations for allegedly operating an uninsured motor vehicle and operating a vehicle with an expired registration.

Jacob E. Fritz, 30, Gillespie, is charged with possession of a controlled substance in connection with an Aug. 20 incident in Gillespie during which he allegedly possessed less than 156 grams of a substance containing heroin.

Kevin T. Kinser, 38, Carlinville is charged with two felony counts of possession of a firearm by a felon and one count of domestic battery in connection with an Aug. 22 incident in Carlinville. Kinser is accused of throwing a beverage glass at his wife, striking her in the right side of her torso. In addition, he is accused of having in his possession a Marlin Model 795 .22 caliber rifle and a quantity of Geco brand ammunition after having been convicted of violating the state’s Firearm Owners Identification Act on Jan. 16, 2005, in Jersey County.

Kenneth D. Bertrand, 45, Edwardsville, is charged with driving on a revoked driver’s license in connection with an Aug. 22 incident during which he allegedly operated a 1998 Ford pickup truck on Illinois Route 159 in Bunker Hill while his license was revoked. The charge was elevated to a felony due to previous convictions for the same offense on Bertrand’s record from March 14, 2001, May 16, 2001, and Dec. 31, 2001, in Madison County. Bertrand also was issued traffic citations for allegedly operating an uninsured motor vehicle and failing to wear a seat beat.

Sergio M. Arrendondo, 34, Chicago, is charged with driving on a revoked driver’s license in connection with a July 26 incident in the southbound lanes of Interstate 55 near milepost 45 in Macoupin County. The charge was elevated to a felony due to five previous convictions for the same offense on Arrendondo’s record dating to 2006 in Cook and DuPage counties.

James D. Pratt, 39, Mount Olive, is charged with retail theft in connection with an Aug. 26 incident during which he allegedly shoplifted two t-shirts valued at less than $300 from the Dollar General Store in Mount Olive. The charge was elevated to a felony due to a previous conviction for felony theft on Pratt’s record from Oct. 16, 2013, in Montgomery County.

MISDEMEANORS

Frank D. Ashmore, Jr., 22, Benld, is charged with two counts of cruel treatment of animals for allegedly leaving two rottweilers unattended in a residence that had no electricity or water in extreme heat for a prolonged period of time, resulting in the death of both dogs. Ashmore was cited on Aug. 4.

Troy L. McIlroy, 53, Gillespie, is charged with domestic battery with bodily harm in connection with an Aug. 21 incident.

Stuart N. Wilson, 31, is charged with domestic battery in connection with an Aug. 22 incident during which he allegedly struck his wife in her face with his closed fist.

Several area residents have been charged with deceptive practice for allegedly writing checks to Macoupin County businesses while knowing their banks would not honor the drafts. Those charged include: Beth A. Tieman, 19, Waverly, accused of writing a bad check for $38.84 on May 4 to SavMor Pharmacy in Virden; Charles E. Conlee, Sr., 49, Bunker Hill, accused of writing a bad check for $70 on June 4 to TJ’s in Benld; Amee J. Munos, 36, Mt. Clare, accused of writing a bad check for $1,300 on July 1 to First National Bank, Staunton; and Kit L. Stoecker, 44, Gillespie, accused of writing a bad check for $56 on July 18 to Roma’s Pizza in Gillespie. In addition, Theresa M. Vicari, 44, Raymond, is charged with three counts of deceptive practice for allegedly writing three bad checks totaling $124.63 between June 18 and June 20 to Boente Shell, Carlinville.

Brett D. Copelin, 27, Thayer, is charged with battery in connection with an Aug. 19 incident in Girard during which he allegedly slapped another male on the arm.

TRAFFIC

Andrew S. Gerling, 29, Benld, is charged with two counts of driving under the influence of alcohol in connection with an Aug. 20 incident about 3:14 a.m. on Illinois Route 4 just south of Carlinville. Gerling also faces a traffic charge for alleged improper lane usage.

Shawn Costello, 52, Carlinville, is charged with two counts of driving under the influence of alcohol in connection with an Aug. 20 incident about 7:20 a.m. on Illinois Route 111 north of Linn Street in Barr Township. In addition, Costello was cited for alleged failure to reduce the speed of his vehicle to avoid an accident, improper lane usage, operation of an uninsured motor vehicle and driving without a valid driver’s license.

Richard D. Muir, 21, Gillespie, is charged with driving under the influence of alcohol in connection with an Aug. 23 incident about 5:41 p.m. on Tower Road south of Quarry Road. In addition, Muir was cited for alleged reckless driving and failure to reduce the speed of his vehicle to avoid an accident.

Michael T. Mitchussson, 24, Gillespie, is charged with two counts of driving under the influence of alcohol in connection with an Aug. 23 incident about 7:24 p.m. on Staunton Road at Charles Street in Gillespie. Mitchusson also was cited for alleged operation of an uninsured motor vehicle, illegal transportation of alcohol by a driver, failure to wear a seat belt, driving without a valid driver’s license and illegal squealing or screeching of tires.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
