LAWSUITS

Darnell Schmitz, Carlinville, is suing Casey’s General Stores, Inc., and Terrie Holmes, Gillespie, for damages in excess of $50,000 for injuries he allegedly sustained in a Jan. 8, 2015, traffic crash in Carlinville. The suit claims Holmes was acting in her capacity as an agent or employee of Casey’s General Stores when the 2013 Chevrolet Malibu she was driving collided with the westbound vehicle Schmitz on West First North Street at its intersection with Plum Street in Carlinville. The complaint alleges Holmes was negligent in that she failed to yield the right-of-way, failed to reduce the speed of her vehicle to avoid the accident, failed to keep a proper lookout and failed to maneuver her vehicle so as to avoid the collision. The two-count lawsuit demands a jury trial and asks for monetary damages to compensate Schmitz for alleged injuries, pain and suffering, medical expenses, loss of income and disfigurement.

Mark Besserman, Wilsonville, is suing Don Brown, Gillespie, for damages in excess of $50,000 for injuries he allegedly sustained in a Dec. 20, 2015, traffic collision in Wilsonville. According to the suit, Besserman was operating a southbound 2008 Ford F-250 on Illinois Route 138 in Wilsonville when a northbound 2005 Chrysler Town and Country driven by Brown allegedly crossed the center line and collided with the Besserman vehicle. The suit claims Brown was negligent in that he allegedly failed to keep his vehicle under proper control, failed to keep a proper lookout, failed to drive his vehicle in the proper lane, crossed the center line when it was unsafe to do so, and failed to yield the right-of-way. The complaint seeks monetary damages for alleged injuries to Besserman’s neck and arms, pain and suffering, medical expenses and loss of income.

Robert Britz has filed a forcible entry and detainer complaint against Roman and Coleen Nowman, Girard, seeking $3,600 in alleged unpaid rent plus possession of residential premises located in the 100 block of South Lincoln Street in Girard.

Donna Beeman has filed a forcible entry and detainer complaint against Ashley Crenshaw, Carlinville, seeking $60 in alleged unpaid rent plus damages and court costs, along with possession of a residential apartment located in the 200 block of East Washington Street in Carlinville.

Rob Hohimer has filed a forcible entry and detainer complaint against Chris Hollon, Giard, seeking $300 in alleged back rent, plus possession of residential premises located in the 600 block of West Bloomington Street in Girard.

Clifford Crispens has filed a forcible entry and detainer complaint against Darrell Pocklington, Girard, seeking $3,500 in alleged unpaid rent, plus possession of residential premises located in the 600 block of West Bloomington Street in Girard.

FELONIES

Benjamin E. Pagel, 31, Carlinville, is charged with aggravated battery in connection with a Sept. 25 incident in Carlinville during which he allegedly punched a Carlinville police officer behind the officer’s right ear while knowing the victim to be a peace officer engaged in the execution of his official duties.

Kammi S. Moore, 23, Butler, is charged with possession of less than five grams of methamphetamine in connection with a Sept. 23 incident in Benld.

Shawn A. Lee, 42, Carlinville, is charged with possession of methamphetamine with the intent to deliver and possession of less than five grams of methamphetamine in connection with a Sept. 24 incident in Carlinville.

Brian K. Venrick, 59, Virden, is charged with aggravated battery in connection with a Sept. 24 incident in Virden during which he allegedly struck a Virden police officer in the face with his closed fist while knowing the victim to be a peace officer engaged in the execution of his official duties.

Dennis J. Gunterman, 51, Springfield, is charged with two counts of aggravated driving under the influence of alcohol, possession of a controlled substance and unlawful use of weapons in connection with a May 14 incident during which he allegedly operated a 2003 Ford pick-up truck on Oak Creek Trail near Mount Olive while under the influence of alcohol. The DUI charges were elevated to felonies due to previous convictions for the same offense on Gunterman’s record from Aug. 28, 1986; Oct. 13, 1987; and March 21, 1994, in Sangamon County. Gunterman also was allegedly found to be in possession of an unspecified amount of amphetamine and was allegedly found to have a loaded .357 Magnum revolver within reach in his vehicle. Traffic charges for allegedly failing to reduce the speed of his vehicle to avoid an accident and operating a vehicle without a valid registration were previously filed in connection with the same incident.

Chris G. Starks, 56, Carlinville, is charged with possession of less than five grams of methamphetamine in connection with a June 1 incident in Carlinville.

Micah J. Ramsey, 30, Plainview, is charged with driving on a revoked license in connection with a Sept. 14 incident in Carlinville during which she alleged drove a 2000 Chevrolet passenger vehicle on North Broad Street at McDaniels Street at a time when her license was suspended and she was eligible for a Monitoring Device Driving Permit.

Gerald L. Sloan, 28, Virden, is charged with aggravated battery in connection with a Sept. 23 incident in Virden during which he allegedly struck a minor under the age of 13 in the facing with his closed fist, causing bruising.

John A. Crisel, 54, Benld, is charged with aggravated battery in connection with a Sept. 28 incident in Benld during which he allegedly kicked a Benld police officer in the back while knowing the victim to be a peace officer engaged in the execution of his official duties.

MISDEMEANORS

Jimmy E. Taylor, 60, Staunton, is charged with domestic battery and interfering with the reporting of domestic violence in connection with a Sept. 24 incident during which he allegedly struck his wife in her face with his closed fist and then attempted to prevent her from reporting the incident to the Macoupin County Sheriff’s Department.

Emmauel D. Welch, 20, Shipman, is charged with criminal damage to property in connection with a Sept. 27 incident during which he allegedly caused less than $300 in damage to a television belonging to another male.

Ryan A. Mosier, 23, Bunker Hill, is charged with criminal damage to property in connection with a Sept. 17 incident during which he allegedly caused less than $300 to the front door or a residence in the 600 block of East Seminary Road in rural Bunker Hill.

Christa M. Stagner, 38, Manchester, Mo., is charged with resisting a peace officer in connection with a Sept. 28 incident during which she allegedly pulled away from a Mount Olive police officer who was attempting to handcuff her. Additionally, she faces traffic charges for allegedly driving on a suspended driver’s license, operating an uninsured motor vehicle and failing to report an accident after the vehicle she was driving allegedly collided with a stop sign in the 300 block of East First North Street in Mount Olive.

Cheyenne N. Barrett, 18, Carlinville, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with a Sept. 29 incident in the parking lot at the Carlinville Walmart store.

Allan M. Springman, 23, Carlinville, is charged with violating a court order of protection in connection with an Oct. 1 incident during which he allegedly entered onto property in the 200 block of South Broad Street in violation of an order of protection issued Sept. 19.

TRAFFIC

Toby J. Butler, 40, Virden, is charged with two counts of driving under the influence of alcohol in connection with a Sept. 24 incident on Center Stret at Eighth Street in Girard at about 11:36 p.m.

David N. Wiens, 30, Carlyle, is charged with two counts of driving under the influence of alcohol in connection with a Sept. 25 incident on Hickory Street at Park Street in Bunker Hill at about 3:10 a.m. Additionally, Wiens faces traffic charge for allegedly operating an uninsured motor vehicle.

SMALL CLAIMS

Mark Smith, Godfrey, is suing Nancy Johns, Benld, for $10,000 he claims he is owed for a diamond engagement ring the defendant failed to return after allegedly calling off the wedding.

Personal Finance Co., LLC, Springfield, is suing Cory Yeager, Carlinville, for $2,406.76, plus interest in the amount of $161.59 and attorney fees in the amount of $361.01, that Yeager allegedly owes on a defaulted $2,610.36 promissory note executed in May 2015 with an interest rate of 30.72 percent.

Discover Bank is suing April I. Hartman, Mount Olive, for $3,036.40, plus court costs, allegedly owed on a defaulted credit card account.

Portfolio Recovery Associates, LLC, is suing Nancy Robertson, Gillespie, for $1,962.67, plus court costs, allegedly owed on a defaulted Synchrony Bank credit card account.

Portfolio Recovery Associates, LLC, is suing Merri L. Bogard, Staunton, for $4,774.59, plus court costs, allegedly owed on a defaulted Citibank credit card account.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
