LAWSUITS

William C. Smock, Springfield, is suing Helma E. McPhail, Farmersville, for more than $50,000 in damages for injuries he allegedly sustained in a 2014 motorcycle/automobile crash in Girard. According to the suit, Smock was operating a southbound motorcycle on North Third Street near its intersection with Mill Street when a northbound vehicle driven by McPhail allegedly attempted a left turn onto Mill Street and collided with Smock’s motorcycle. The suit alleges McPhail was negligent in that she allegedly failed to yield the right-of-way to Smock’s vehicle, drove across the intersection at an excessive rate of speed, failed to reduce the speed of her vehicle to avoid the collision, operated her vehicle at a speed that was too fast for conditions, failed to keep a proper lookout for other vehicles, failed to stop her vehicle to avoid the collision, failed to keep her vehicle under proper control and failed to use every precaution to avoid the collision. Smock claims to have sustained permanent injuries to his left leg, knee and ankle, arms, neck and head. He seeks a monetary judgment to compensate him for alleged pain and anguish, medical expenses and loss of income. A jury trial is demanded.

Professional Property Management, LLC, has filed a forcible entry and detainer complaint against Denine L. Helander, Smantha B. Stanger and Zachary B. McCoy, seeking possession of a residential apartment in the 600 block of North Dye Street in Virden, along with monetary damages specifically from Helander. According to the suit. Helander was employed as a property manager at Virden Apartments. As part of her compensation package, Helander allegedly was provided with an apartment in which to live at the complex. Stanger and McCoy allegedly also continue to occupy the apartment and therefore are included in the suit, according to the complaint. The suit alleges Helander and the other defendants refused to vacate the apartment, as allegedly required by contract, after Helander was terminated in July. In addition to possession of the premises, Count II of the suit seeks $6,100 in damages allegedly due under the employment contract, plus $100 per day until the time of judgment. Count III, seeks past due rent in the amount of $273. In addition, the suit seeks compensation for the cost of the lawsuit and $2,500 in attorney fees.

Lavern Harvey, Palmyra, has filed a forcible entry and detainer complaint against Melissa and Jeremy Miller, Virden, seeking $780 in alleged back rent along with possession of residential premises located in the 300 block of South Dye Street in Virden.

Vanderbilt Mortgage and Finance, Inc., has filed a complaint in replevin against Matthew R. and Katherine I. Holman, Bunker Hill, seeking possession of a 2009 Clayton manufactured/mobile home now valued at $14,198.55. The complaint alleges the plaintiff is entitled to possession of the property after the couple allegedly defaulted on a loan executed in March 2010 for the purchase of the mobile home.

Joseph R. Boente Sons, Inc., Carlinville, is suing Tony Houseman, Carlinville, for $629.83, plus court costs, allegedly owed for services.

Macoupin Veterinary Clinic, Carlinville, is suing Jean E. Beal, Carlinville, for $611.91, plus court costs, allegedly owed for services.

Plaza Truck Service, Inc., Carlinville, is suing Kenny Logue, New Douglas, for $2,259.99, plus court costs, allegedly owed for services.

Macoupin Veterinary Clinic, Carlinville, is suing Carol A. Smith, Carlinville, for $174.37, plus court costs, allegedly owed for services.

Paul F. Gowin, Girard, is suing Leslie Guthrie, Girard, alleging Guthrie stopped payment on $2,400 owed to the plaintiff for a truck.

Portfolio Recovery Associates, LLC, is suing Susan Allen, Staunton, for $3,567.47, plus court costs, allegedly owed on a defaulted credit card account.

Reid’s Tire and Auto, Gillespie, is suing Kenny Harbaugh, Gillespie, for $453.13 that Harbaugh allegedly owes for automotive repairs.

Gray Lumber Yard, Modesto, is suing Robyn Roberts, Greenfield, for $1,225.97, plus court costs, that the defendant allegedly owes the plaintiff.

Heritage Manor-Staunton is suing Alisa Dewitt, Worden, for $8,053.50, plus court costs and attorney fees, allegedly owed for nursing home care for which the defendant was the responsible party.

FELONIES

Marshall P. Simmons, 24, Carlinville, is charged with possession of a controlled substance in connection with an Oct. 15 incident in Carlinville during which he allegedly was in possession of less than 15 grams of a substance containing cocaine.

Robert D. Farmer, 52, Shipman, is charged with two counts of aggravated driving under the influence of alcohol and one count of driving on a revoked driver’s license in connection with a July 27 incident during which he allegedly operated a 2003 GMC pickup truck on Fosterburg Road. The DUI charges were elevated to felonies because Farmer allegedly was driving on a revoked driver’s license at the time of the offense and because of previous convictions for the same offense on Farmer’s record from July 18, 2008, and Sept. 7, 1984 in Madison County, July 31, 2012, in Macoupin County, and May 26, 2016, in Dane County, Wisconsin. The driving on a revoked license charge was elevated to a felony due to previous convictions on Farmer’s record for the same offense from May 15, 2013, in Macoupin County and Nov. 10, 2015, in Dane County, Wisconsin.

Kari A. McKinney, 40, Carlinville, is charged with theft for allegedly exercising unauthorized control over more than $100,000 but less than $500,000 in cash belonging to Gwillim Trucking, Carlinville, between November 2014 and February 2016 with the intent to permanently deprive the owner of the use of the property.

Ashley N. Thompson, 36, Auburn, is charged with possession of less than five grams of methamphetamine in connection with an Oct. 17 incident.

James R. Varble, 46, Hettick, is charged with possession of less than five grams of methamphetamine in connection with an Oct. 18 incident in Carlinville.

Lorie J. Frank, 41, Benld, is charged with residential burglary in connection with an Oct. 18 incident during which she allegedly entered a rural Gillespie home without authority and with the intent to commit a theft.

Mandy M. Gibbons, 38, Gillespie, is charged with possession of less than five grams of a substance containing methamphetamine in connection with an Oct. 18 incident in Gillespie.

MISDEMEANORS

Brandy D. Dawdy, 40, Greenfield, is charged with deceptive practice for allegedly writing a check for $23.21 on June 2 to Darr’s Pit Stop, Medora, while knowing her bank would not honor the draft.

Kevin J. Black, 30, Sawyerville, is charged with deceptive practice for allegedly writing a check for $23.21 on Aug. 7 to T.J.’s, Benld, while knowing his bank would not honor the draft.

In separate cases, Jeffery L. Herron, III, 21, and Kyrah E. Pernicka, 21, both of Staunton, are charged with retail theft in connection with a Sept. 30 incident during which they allegedly shop-lifted four Loko alcoholic beverages from Circle K in Staunton.

Misty R. Rice, 40, Carlinville, is charged with criminal trespass to railroad property in connection with an Oct. 8 incident during which she allegedly walked along a Union Pacific Railroad right-of-way near Rinaker Road at a location other than a public crossing.

William T. Borgini, 19, Staunton, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with an Oct. 7 incident on North Union Street at East North Street in Staunton.

Donald E. Gray, Jr., 46, Staunton, is charged with aggravated assault in connection with an Oct. 18 incident during which he allegedly pointed a cordless drill at a Staunton police officer knowing him to be a peace officer engaged in performing his official duties.

Shane J. Lomelino, 34, Palmyra, is charged with resisting a peace officer in connection with an Oct. 18 incident during which he allegedly refused to support his own weight as a Macoupin County Sheriff’s deputy was attempting to search him and place him into a squad car.

Bo D. Buffington, 18, Litchfield, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with an Oct. 14 incident at a bean field on Litchfield Trail.

Walter A. Wallace, 36, Gillespie, is charged with battery in connection with an Oct. 20 incident during which he allegedly punched a male victim in the face, causing the victim to bleed.

Austin M. Weatherford, 19, Carlinville, is charged with theft in connection with a Sept. 25 incident during which he allegedly obtained unauthorized control over a Playstation, valued at less than $500, that he knew to be stolen.

Tucker L. Clinton, 21, Carlinville, is charged with unlawful use of weapons in connection with an Oct. 7 incident during which he allegedly possessed a 9 mm Hi-Point pistol that was uncased and within immediate reach within his vehicle without having a concealed carry license.

Jay M. Parker, 25, East Alton, is charged with possession of cannabis in connection with a June 11 incident during which he allegedly possessed 10 to 30 grams of a substance containing cannabis.

Patricia L. Senter, 45, St. Louis, Mo., is charged with unauthorized display of a registration sticker in connection with an Oct. 8 incident during which she allegedly displayed a sticker on a 1999 Lexus that was registered to another vehicle.

Matthew W. Stoops, 24, Staunton, is charged with criminal trespass to property in connection with an Oct. 21 incident during which he allegedly entered property in the 100 block of West Mill Street in Staunton after being notified that such entry was forbidden.

Bethany E. Robinson, 18, Carlinville, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with a Sept. 30 incident in the 300 block of Hickory Street in Staunton.

TRAFFIC

Kayla M. Smith, 26, Palmyra, is charged with two counts of driving under the influence of alcohol in connection with an Oct. 4 incident on North Road. Smith also faces a traffic charge for alleged improper parking on a roadway.

Kimberly R. Roth, 41, Virden, is charged with two counts of driving under the influence of alcohol in connection with an Oct. 16 incident on Waverly Street at Blair Street in Virden. She also faces a traffic charge for alleged illegal transportation of alcohol by a driver.

Karen L. Downey, 43, Girard, is charged with driving under the influence of alcohol in connection with an Oct. 17 incident on Farmersville Road at Ball Road. In addition, Downey was issued traffic citations for allegedly making an improper turn signal, alleged improper lane usage and alleged operation of an uninsured motor vehicle.

Jason T. Gibbs, 32, Hettick, is charged with two counts of driving under the influence of alcohol in connection with an Oct. 16 incident on Illinois Route 111 at Hettick Road about 3 a.m. In addition, he faces a traffic charge for alleged improper lane usage.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
