LAWSUITS

A Wood River-based business is suing a Gillespie man for damages in excess of $50,000, claiming the defendant defamed the business in a post on Facebook. The plaintiff, Fenix 5ive, LLC, an automotive graphics and tinting business, claims Anthony Kuehnel posted the allegedly defamatory comment on Facebook shortly after it opened a second location in Carlinville. Adding a comment to a conversation on on Facebook, Kuehnel allegedly posted, “Ah Fenix 5ive business thief.” The suit alleges Kuehnel made a “false and harmful statement attacking the integrity, competence or other reputational value of Fenix 5ive” on Sept. 22. Further, the suit alleges the statement was communicated to third party business partners, including the operator of the recently opened Carlinville location, potential customers and the landlord who owns the premises where the Carlinville business is located. The plaintiff claims the statement was made with malice, intending to harm the plaintiff’s “business relationships and financial interests, and the reputation of Fenix 5ive. Fenix 5ive alleges the defamatory statement caused injury to its reputation, cost the business potential customers and sales, and caused difficulties with the business’ landlord. The suit seeks punitive and actual damages in excess of $50,000, along with an injunction requiring the defendant to remove the post and refrain from posting further defamatory statements. A jury trial is demanded.

Keith Grench is suing BCarter Enterprises, Inc., doing business as The Bunkhouse in Bunker Hill, owner Kenneth Herrin of Glen Carbon, and Mark Swarringin of Bunker Hill, for damages in excess of $50,000 for injuries Grench allegedly sustained when Swarringin allegedly shot him in the hand early on Aug. 7 while at the bar. The actions against BCarter Enterprises and Herrin are brought under provisions of the state’s Dramshop Act, while Swarringin is being sued individually. According to the suit, Swarringin was served alcoholic beverages to the point of intoxication while at the Bunkhouse. At about 1:30 a.m., the suit claims, Swarringin attacked Grench while inebriated and shot Grench in the hand with a gun. He seeks monetary damages for his injuries, pain and suffering, and medical expenses. A jury trial is demanded.

Ruth E. Loveless has filed a forcible entry and detainer complaint against Walter Wallace, Gillespie, seeking possession of an apartment located in the 400 block of Montgomery Street, Gillespie. The complaint seeks no monetary damages but alleges Wallace violated terms of his rent agreement by allegedly allowing the premises to be used for unlawful purposes. Wallace, 36, was convicted Nov. 1 on a misdemeanor charge of tattooing the body of a minor.

Sylvia Newingham, Gillespie, had filed a forcible entry and detainer complaint against Heather Reid, Gillespie, seeking $1,390 in alleged back rent, plus damages, court costs and possession of residential premises located in the 300 block of Jersey Street in Gillespie.

Kyle Gibbs has filed a forcible entry and detainer complaint against Scott Drew and Trina Christian, Virden, seeking $1,177.41 in alleged back rent, plus possession of a residential apartment located in the 200 block of South Springfield Street in Virden.

Central Illinois Realty Co. has filed a forcible entry and detainer complaint against Annyssa Myers, Virden, seeking $570 in alleged back rent and late fees, plus $1,276 in court costs and possession of premises located at 17 Whispering Pines, Virden.

John Suzuki, as a court appointed receiver, has filed a forcible entry and detainer complaint against a pair of defendants the receiver claims is unlawfully “squatting” on property in the 800 block of North Broad Street in Carlinville. Named as defendants are Kendra Nix, known now as Kendra Striplin, and Sean Lee. The complaint claims the defendants are living in a non-operating laundromat on the property. The property also includes a gas station and the plaintiff claims he has entered into an agreement with the gas station operators to acquire the laundromat building that the defendants allegedly occupy unlawfully.

Ron Jordan has filed a forcible entry and detainer complaint against Valerie Fritz, Gillespie, seeking possession of residential premises located in the 14000 block of Illinois Route 138 in rural Gillespie. No monetary judgment is sought.

Tim Loveless, Gillespie, has filed a forcible entry and detainer complaint against Michael and Crystal Helfers, Bend, seeking $532 in alleged back rent plus possession of residential premises located in the 200 block of West Hickory Street in Bend.

SMALL CLAIMS

Portfolio Recovery Associates, LLC, is suing Jamie L. Bomkamp, Girard, for $531.61, plus court costs, allegedly owed on a defaulted Comenity Bank credit card account.

Portfolio Recovery Associates, LLC, is suing Dustin Allen, Mount Olive, for $598.98, plus court costs, allegedly owed on a defaulted Citibank credit card account.

Midland Funding, LLC, is suing Deborah Carty, Carlinville, for $5,439.11, plus court costs, allegedly owed on a defaulted Capital One Bank credit card account.

Cavalry Spv I, LLC, is suing Barbara J. Grant, Bend, for $4,315.94, plus court costs, allegedly owed on a defaulted Citibank credit card account.

Carlinville Area Hospital is suing William L. and Tracy Byars, Gillespie, for $1,157.23, plus court costs, allegedly owed for medical services.

FELONIES

Jason Hart, 43, Carlinville, is charged with two counts of aggravated battery in connection with a Nov. 6 incident in the 600 block of East Nicholas Street near Johnson Street in Carlinville. Hart, who resides in the 500 block of Johnson Street, is accused of shooting two juvenile males–one in the torso and the other in the hand—on the neighboring property on East Nicholas Street at about 1:48 a.m. Bond is set at $250,000 and a preliminary hearing is set in the case for 1:30, Tuesday, Nov. 22, before Macoupin County Circuit Judge Kenneth Deihl.

Kenneth C. Jones, 34, Virden, is charged with possession of methamphetamine and resisting a peace officer in connection with a Nov. 14 incident in Virden during which he allegedly was in possession of less than five grams of methamphetamine and ran away from a Virden police officer after being lawfully detained. In addition, Jones faces a traffic charge for allegedly violating the law as it pertains to the use of bicycles.

Adam Bray, 35, Gillespie, is charged with possession of a controlled substance in connection with an Oct. 8 incident in Gillespie during which he allegedly possessed less than 15 grams of a substance containing Oxycodone.

James A. Iler, 43, Brighton, is charged with driving on a revoked driver’s license in connection with an Aug. 14 incident during which he allegedly operated a 2000 GMC Safari on Olive Street at North Street in Brighton while is license to drive was suspended or revoked. The charge was elevated to a felony due to a previous conviction for the same offense on Iler’s record from Dec. 15, 2015, in Jersey County. Iler previously was charged with two counts of driving under the influence of alcohol in connection with the same incident.

MISDEMEANORS

Brock J. Bone, 22, Carlinville, is charged with unlawful delivery of alcohol to a minor in connection with a Nov. 8 incident during which he allegedly purchased alcoholic liquor for a 14-year-old juvenile.

Kelcie N. Woodring, 19, Gillespie, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with an Oct. 23 incident at Blackburn College, Carlinville.

Jersey W. Robinson, 20, and Zachary R. Rogers, 19, both of Carlinville, have each been charged with unlawful consumption of alcohol by a person under the age of 21 in connection with an Oct. 21 incident on North Broad Street at Washington Street in Carlinville.

Michael D. Wofford, 42, Staunton, is charged with domestic battery in connection with a Nov. 14 incident during which he allegedly threw a box fan at his wife.

Tucker F. Stelle, 26, Virden, is charged with battery in connection with an Oct. 25 incident during which he allegedly struck a male victim in the face with his closed fist, causing bruising.

In separate cases, Shelia M. Richardson, 44, and Gerald R. Miller, 49, both of Carlinville, are charged with permitting a violation of the Illinois Liquor Control Act on Nov. 5 and Nov. 6 at their home in the 500 block of Denby Street in Carlinville. The pair are accused of allowing a 17-year-old invited to the home by a member of their family to unlawfully consume alcoholic liquor while at the residence.

Caleb J. Shores, 19, Carlinville, is charged with littering in connection with a Nov. 4 incident during which he allegedly threw a fast food container out the window of the vehicle he was driving on Second Street at Madison Street in Girard.

William G. Humphries, 59, Staunton, is charged with domestic battery in connection with a Nov. 16 incident during which he allegedly grabbed his wife by her neck and squeezed.

Evan D. Woodside, 19, Florissant, Mo., is charged with criminal damage to property in connection with a Nov. 18 incident in Gillespie during which he allegedly caused less than $300 in damage to a Chrysler automobile belonging to a Gillespie female by keying the paint.

TRAFFIC

Terry L. White, 55, Benld, is charged with two counts of driving under the influence of alcohol in connection with an Oct. 29 incident on Illinois Route 4 at Commercial Court, Benld. In addition, he faces traffic charges for alleged improper lane usage and unlawful transportation of alcohol by a driver.

William R. Heyen, 42, Gillespie, is charged with two counts of driving under the influence of alcohol in connection with a Nov. 6 incident on South Madison Street at Route 66 in Staunton at about 3:30 a.m. In addition, Heyen faces a traffic charge for allegedly operating an uninsured motor vehicle.

Justin L. Dugan, 27, Granite City, is charged with two counts of driving under the influence of alcohol in connection with a Nov. 12 incident in the northbound lanes of Interstate 55 near mile marker 43. Dugan also faces traffic charges for allegedly driving on a suspended driver’s license, operating and uninsured motor vehicle and unlawfully transporting alcohol.

Zachary J. Daggett, 36, Carlinville, is charged with driving under the influence of alcohol in connection with a Nov. 12 incident at about 12:52 a.m. on Northwest Street at Substation Street in Carlinville. Daggett also faces a traffic charge for allegedly failing to reduce the speed of the vehicle he was driving to avoid an accident.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
