LAWSUITS

Barbara J. and Erwin A. Behme, Carlinville, are seeking a judgment in excess of $50,000 from a Carlinville woman whose dog allegedly knocked Barbara Behme down two years ago as she was walking on the sidewalk near her home on White Tail Drive in the Bluffs Subdivision. Named as defendant is Marcia (Marsha) Crane, also of Carlinville. A jury trial is demanded. According to the suit, Barbara Behme was walking on the sidewalk about 10 a.m., Dec. 29, 2014, when Crane’s dog allegedly ran up to her and knocked her down, causing injuries. The nature and extent of the injuries are not described. Count I of the suit seeks to hold Crane liable under provisions of the Animal Control Act, which requires dog owners to keep pets under control. Count II alleges Crane was negligent in failing to cage, leash or otherwise restrain the dog, allowing the dog to roam the sidewalk and endanger invitees, and keeping a dog on her premises that she knew to be uncontrollable. The suit seeks more than $50,000 in damages for Barbara Behme for her injuries, pain and suffering, and medical expenses. In a third count, Erwin Behme seeks damages in excess of $50,000 for alleged loss of consortium with his wife due to her injuries.

Matthew M. Schwab has filed a forcible entry and detainer complaint against Jake Hardas, Mount Olive, seeking $1,000 in alleged back rent, along with damages and possession of residential premises located in the 300 block of North Walnut Street in Mount Olive.

Vickie Laughlin, Kathleen Laboray and Karen Hinz, as guardians of the Estate and Person of Jessie Foster, have filed a forcible entry and detainer complaint against Steven Foster, Mount Olive, seeking possession of premises located in the 21400 block of Illinois Route 138, Mount Olive.

Plaza Truck Service, Inc., Carlinville, is suing Jeffrey S. Petri, Jacksonville, for $2,008.12, plus court costs, that the plaintiff claims to be owed.

Midland Funding, LLC, is suing Barbara Jones, Mount Olive, for $939.09, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Synchrony Bank/Care Credit card account.

Midland Funding, LLC, is suing Amy Burch, Virden, for $830.74, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Synchrony Bank/Walmart credit card account.

Midland Funding, LLC, is suing Chase Bitschenauer, Virden, for $818.23, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Synchrony Bank/Walmart credit card account.

Cavalry Spv I, LLC, is suing Robin A. Hammann, Girard, for $6,700.05, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Citibank credit card account.

Midland Funding, LLC, is suing Joseph McGee, Benld, for $868.35, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Citibank/Best Buy credit card account.

Jefferson Capital Systems, LLC, is suing George R. Robson, Girard, for $2,993.01, plus court costs, that the plaintiff claims is owed on an allegedly defaulted student loan executed with Navient Credit Finance Corp.

Citibank is suing Jessica H. Copeland, Gillespie, for $9,521.03, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Citibank credit card account.

Portfolio Recovery Associates, LLC, is suing Merri L. Bogard, Staunton, for $2,238.24, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Citibank/Sears credit card account.

Portfolio Recovery Associates, LLC, is suing Shirley J. Sherrer, Girard, for $6,732.67, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Citibank/Sears credit card account.

Midland Funding, LLC, is suing Austin Morrissey, Girard, for $831.65, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Credit One Bank credit card account.

Midland Funding, LLC, is suing Wyatt Johnson, Alton, for $3,586.49, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Synchrony Bank/Lowe’s credit card account.

Midland Funding, LLC, is suing Elizabeth Stewart, Carlinville, for $2,594.90, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Synchrony Bank/Sam’s Club credit card account.

Midland Funding, LLC, is suing Alek Spickerman, Bunker Hill, for $802.33, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Credit One Bank credit card account.

Midland Funding, LLC, is suing Wayne Spicer, Carlinville, for $1,289.55, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Synchrony Bank/Care Credit card account.

Capital One Bank is suing Darryll E. Gunning, Carlinville, for $1,542.94, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Capital One Bank credit card account.

FELONIES

Theodore Holmes, 46, Palmyra, is charged with retail theft in connection with an Oct. 18 incident in Palmyra during which he allegedly shoplifted merchandise valued at less than $300. The charge was elevated to a felony due to a previous conviction for a similar offense on Holmes’ record.

Kayla M. Yeager, 27, Litchfield, is charged with delivery of methamphetamine in connection with a Sept. 15 incident during which she allegedly delivered less than five grams of methamphetamine to another individual.

Joshua R. Nance, 33, Girard, is charged with two counts of unlawful possession of a firearm by a felon in connection with a Dec. 15 incident in Girard during which he allegedly possessed a Hi-Point .40 caliber pistol, along with ammunition.

Thomas A. Hess, 32, Virden, is charged with predatory criminal sexual assault of a child in connection with a Nov. 10 incident. Bond for Hess was set at $250,000.

MISDEMEANORS

Evan M. W. Crane, 18, Brighton, is charged with domestic battery in connection with a Nov. 12 incident in Brighton during which he allegedly made physical contact of an insulting or provoking nature by placing his mother in a headlock.

Charles E. Conlee, Jr., 26, Bunker Hill, is charged with obstructing a peace officer in connection with a Dec. 2 incident during which he allegedly fled from a Macoupin County Sheriff’s detective who had lawfully detained Conlee.

Jessica N. Landrey, 40, Virden, is charged with escape for allegedly failing to report to Macoupin County Jail on Dec. 19 pursuant to a jail order issues Aug. 9 in connection with a traffic case in which she was convicted of driving on a suspended driver’s license.

Jodi L. Flack, 39, Benld, is charged with domestic battery in connection with an Oct. 10 incident in Benld during which she allegedly made contact of an insulting or provoking nature by striking a member of her household on the back with a belt.

TRAFFIC

Gregory M. Aldama, III, 25, Springfield, is charged with two counts of driving under the influence of alcohol in connection with a Dec. 18 incident at 2:18 a.m. on Pine Street at Macoupin Street in Gillespie. Additionally, Aldama faces a traffic charge for alleged operation of an uninsured motor vehicle.

Randall J. Motley, 26, Hettick, is charged with two counts of driving under the influence of alcohol in connection with a Dec. 22 incident at 2:28 a.m. in the 700 block of Washington Street in Bunker Hill. Motley also was cited for allegedly driving without a valid driver’s license.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
