LAWSUITS

A Carlinville woman is suing Veterans of Foreign Wars Post 1104, Carlinville, and Gregory McKinney, the club manager, for damages in excess of $50,000 for injuries she allegedly sustained in a fall on a deteriorated stairway on Nov. 7, 2015. The plaintiff, Teresa Crum, claim she sustained external and internal injuries of a permanent and lasting nature, suffered physical and mental pain, incurred medical expenses and lost income as a result of slipping and falling on a stairway at the Post home in the 200 block of South West Street in Carlinville. The suit claims Crum slipped and fell on the last step of a short, seven-step concrete stairway between the basement and upper floor of the Post home. The last step, according to the suit, was damaged, leaning in one direction and covered with loose carpeting. The handrail allegedly did not extend to the last step and the landing was uneven from a previous repair and also covered with loose carpeting. The two-count suit alleges negligence on the part of the VFW and McKinney in that they allegedly allowed an unsafe condition to exist, covered the damaged step and floor with loose carpeting, allowed members of the general public to use the unsafe stairway and failed to warn members of the public about the unsafe conditions. A jury trial is demanded.

Roy Davis, Carlinville, has filed a forcible entry and detainer complaint against Melissa Reed and James Branham, Carlinville, seeking $3,450 in alleged unpaid rent, along with court costs, damages and possession of residential premises located in the 900 block of Johnson Street in Carlinville.

Maria Thur, Plainview, has filed a forcible entry and detainer complaint against Jeremy Chaikowsky and Tayler Threadgill, Plainview, seeking $4,500 in alleged unpaid rent, plus possession of residential premises located in the 7200 block of Drew Road in rural Plainview.

A complaint in replevin filed on Feb. 14 with dismissed two days later on a motion by the plaintiff. Larry Baker, Jr., originally had alleged that Tabitha Eichen, Carlinville, wrongfully detained about $1,500 worth of property belonging to him, including two televisions, a Dish satellite system, a sound system and personal papers. A Macoupin County judge granted Baker’s motion to dismiss the complaint on Feb. 16.

Ruth Loveless, Gillespie, has filed a forcible entry and detainer complaint against Adam Daniels, Wilsonville, seeking $1,016.78 in alleged unpaid rent and water bills, along with court costs and possession of residential premises located in the 100 block of Simmons Street in Wilsonville.

Heritage Manor, Staunton, is suing Judy M. Rosenthal and Teresa K. Swenson for $46,346.11, plus court costs, allegedly owed for nursing home care provided to Rosenthal from Oct. 23, 2015, to Oct. 21, 2016. The two-count suit seeks to hold Rosenthal financially responsible for the bill and alleges Swenson also signed the original contract as the party responsible for payment.

Helen Zarr, Staunton, has filed a forcible entry and detainer complaint against McKenzie Hayes, Staunton, seeking $2,700 in alleged unpaid rent, along with court costs and possession of residential premises located in the 100 block of South Laurel Street in Staunton.

Tim Loveless, Gillespie, has filed a forcible entry and detainer complaint against James L. Webb, Gillespie, seeking $1,500 in alleged unpaid rent, plus court costs and possession of residential premises located in the 100 block of Richards Street in Gillespie.

Tim Loveless, Gillespie, has filed a forcible entry and detainer complaint against Timothy Campbell, Wilsonville, seeking $1,929.13 in alleged unpaid rent and water bills, along with court costs and possession of residential premises located in the 100 block of School Street in Wilsonville.

SMALL CLAIMS

Capital One Bank is suing Nicholas P. Watson, Carlinville, for $3,010.33, plus court costs, that the plaintiff claims is owed on an allegedly defaulted credit card account.

Consumer Collection Management, LLC, is suing Michael R. and Teresa Scott, Gillespie, for $4,346.48, plus court costs, that the plaintiff claims is owed for allegedly unpaid medical bills. The plaintiff seeks $1,846.48 on behalf of St. Francis Hospital, Litchfield, and $2,500 on behalf of St. John’s Hospital, Springfield.

Consumer Collection Management, LLC, is suing Jeffrey and Jeanette Whittler, Girard, for $3,048.80, plus court costs, that the plaintiff claims is owed for medical bills. The plaintiff seeks to recover $317 on behalf of Girard Family Health Care, $1,485.26 for Carlinville Area Hospital and $1,246.54 allegedly owed to St. John’s Hospital, Springfield.

Midland Funding, LLC, is suing Mandy Swick, Mount Olive, for $910.71, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Credit One Bank credit card account.

Hughes Finance Corp. is suing Lisa M. Barnett, Mount Olive, for $2,203.47, plus court costs, allegedly owed on a $2,599.94 federal disclosure statement executed Nov. 19, 2015, at an interest rate of 34.57 percent.

Mariner Finance, LLC, is suing Stephen E. Harris, Virden, for $4,405.73, plus court costs, allegedly owed on a $3,830 note and security agreement executed Oct. 24,2016, at an interest rate of 35.99 percent.

World of Power Sports, Decatur, is suing Shain L. Tooley, Mount Olive, for $9,500, plus court costs, allegedly owed for a Sea Dog and trailer purchased on credit in June 2016.

LVNV Funding, LLC, is suing Malinda L. Lewis, Virden, for $2,729.01, plus court costs, allegedly owed on a defaulted Meta Bank charge account.

Washington University is suing Dustin Gentry, Bunker Hill, for $708.34 that the plaintiff claims is owed for medical services.

Heights Finance Corp., Peoria, is suing Ursula Barnes, Gillespie, for $4,284.20, plus court costs and interest at a rate of 33.74 percent, that the plaintiff claims is owed on a defaulted $4,343.07 consumer loan executed Oct. 2, 2015, at a rate of 34.22 percent.

FELONIES

Danny G. Kline, 32, Plainview, is charged with one count of aggravated domestic battery and three counts of aggravated battery in connection with a Feb. 8 incident in rural Plainview during which he allegedly attacked his girlfriend and one of her children with his fists and a crescent wrench. Kline is accused of causing great bodily harm to his girlfriend by striking her in the head with his fists and a crescent wrench, and using the wrench to also strike the juvenile in the head.

Jamil W. Gibbs, 34, Cahokia, is charged with possession of a weapon by a felon, unlawful use of a weapon and possession of a controlled substance in connection with a Feb. 9 incident about 7:37 p.m. on Interstate 55 on Interstate 55 near mile marker 48. Gibbs allegedly was found to be in possession of less than 15 grams of a substance containing cocaine and to be carrying an immediately accessible 9mm Taurus pistol in his vehicle when an Illinois State Police trooper initiated a traffic stop. Gibbs also was issued traffic citations for allegedly operating a vehicle with illegally tinted front and side windows, and a cracked windshield.

Casey Smith, 25, Carlinville, is charged with possession of less than five grams of methamphetamine in connection with a Jan. 24 incident in Gillespie.

Joshua Nurdin, 25, Mount Olive, is charged with possession of less than five grams of methamphetamine in connection with a Jan. 24 incident in Gillespie.

Joshua W. Dickerson, 29, Gillespie, is charged with possession of a controlled substance in connection with a July 1, 2016, incident in Gillespie during which he allegedly possessed an unspecified quantity of Buprenorphine.

MISDEMEANORS

Several area residents have been charged with deceptive practice for allegedly writing checks to local businesses while knowing their banks would not honor the drafts. In separate cases, those charged include: Tisha L. Kester, 38, Benld, accused of writing a bad check for $30 on Nov. 3, 2016, to the Animal Doctor, Staunton; Kayla Shaw, 28, Staunton, accused of writing a bad check for $79.46 on Nov. 26, 2016, to Bill’s IGA, Staunton; Suzanne L. Robbins, 33, Gillespie, accused of writing a bad check for $171.74 on Oct. 26, 2016, to Randy’s Market, Gillespie; and Brandon M. Lyons, 26, Gillespie, accused of writing a bad check for $100 on Nov. 4, 2016, to Chief’s II, Gillespie, and a bad check for $177.75 on Sept. 13, 2016, to Skeeter’s Pub, Staunton.

Timothy Y. Adams, 24, Granite City, is charged with littering from a vehicle in connection with a Jan. 28 incident at about 12:33 a.m. during which he allegedly tossed a cigarette from his vehicle while traveling south on Interstate 55 near mile marker 47.5.

Breanna L. Livingston, 20, Morrisonville, is charged with retail theft in connection with a Feb. 5 incident during which she allegedly shop-lifted a bottle of Malibu liquor from Walmart in Carlinville.

Cheyenne N. Barrett, 18, Carlinville, is charged with retail theft in connection with a Feb. 5 incident during which she allegedly shop-lifted a bottle of Jack Daniels whiskey from Walmart in Carlinville.

Joanne L. Dotson, 26, Decatur, is charged with obstructing identification in connection with a Jan. 25 incident during which she allegedly provided a false name to an Illinois State Police trooper after being lawfully detained.

TRAFFIC

Jason M. Hargis, 22, Bunker Hill, is charged with driving under the influence of alcohol in connection with a Jan. 31 incident at about 5:03 a.m. on Seminary Road at Union Road. In addition, Hargis faces traffic charges for allegedly operating an uninsured motor vehicle and leaving the scene of an accident.

Sheila M. Richardson, 44, Carlinville, is charged with two counts of driving under the influence of alcohol in connection with a Feb. 16 incident on South Locust Street at West First South Street in Carlinville. She also faces traffic charges for alleged illegal transportation of alcohol by a driver and making an improper turn at an intersection.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
