LAWSUITS

Caterpillar Financial Services, Inc., headquartered in Nashville, Tenn., has filed a complaint in replevin seeking a court order to take possession of more than $200,000 worth of equipment from a Hettick bulldozing company. Named as defendants are Jackson Bulldozing and Excavating, Inc., company owner Benjamin K. Jackson, Hettick, and Lisa McMullan, also of Hettick, who allegedly signed as personal guarantor for a portion of the company’s indebtedness to the plaintiff. The suit seeks a court order for the plaintiff to recover a Caterpillar D6RIII track type tractor with an estimated value of $79,200, a Caterpillar 320D6 hydraulic excavator estimated to be worth $46,700, a 2011 Caterpillar 402F backhoe loader estimated to be worth $42,000 and a Caterpillar 305ECR hydraulic excavator with an estimated worth of $38,400. According to the suit, Jackson Bulldozing entered into an installment loan to purchase the 420F backhoe loader in September 2015 and later entered into an installment loan agreement to purchase the 305ECR hydraulic excavator in April 2016. The company allegedly pledged the additional equipment to secure the loan as part of a cross collateral/cross default agreement at the time of the September 2015 purchase.
