LAWSUITS

Monsanto Co. is suing William L. Royer, Girard, for $57,074.23, plus interest, attorney fees and court cost, that the plaintiff claims is owed for seed products purchased on credit after Feb. 10, 2014. The two-count lawsuit alleges Royer entered into an interest-free agreement with Brandt Consolidated enabling him to purchase agricultural seed products from Brandt on credit. The suit claims Royer ordered and accepted merchandise from Brandt, accumulating a debt of $57,074.23, which Brandt assigned to Monsanto for collection. The suit seeks a judgment for the amount Royer allegedly owed, plus attorney fees, court costs and interest calculated at a rate of $7.81 per day from Oct. 13, 2016, the date of judgment.

Rachel Casella, Atwood, has filed a forcible entry and detainer complaint against Myron Marshall, Shipman, seeking possession of residential premised located in the 300 block of Church Street in Shipman.

Ruth Loveless, Gillespie, has filed a forcible entry and detainer complaint against Jordan Trimm and Kourtney Clare, Benld, seeking $814 in alleged back rent, plus court costs, additional pro-rated rent and possession of residential premises located in the 200 block of North Seventh Street in Benld.

Jashlin, Ltd., Bunker Hill, Harold Wieseman, President, has filed a forcible entry and detainer complaint against Spencer and Alicia Mims, Bunker Hill, seeking a judgment totaling $12,025., plus possession of premises in the 200 block of Washington Street, Bunker Hill, and the 200 block of West Park Street, Bunker Hill. The suit alleges the defendants owe $4,500 and unpaid rent for the Washington Street property. For the Park street property, the defendants allegedly owe $4,750 in unpaid rent, plus $2,775 for repairs to the property.

State Farm & Casualty Co., as an assignee of Jeffrey T. Blumenstein, Brighton, is suing G. L. Warren Construction, Inc., Brighton, for $17,245.33 for damage allegedly done to Blumenstein’s home as a result of a sewer back-up in March 2013. The suit alleges representatives of Warren Construction are responsible for the damage as a result of driving over and damaging a check valve while working on a sewer line replacement project under a contract with the City of Brighton. The suit alleges Warren Construction was negligent in allegedly failing to proper install the replacement sewer line, improperly parking equipment on Blumenstein’s property and running over the check valve. State Farm paid Blumenstein’s insurance claim, according to the suit, which it now seeks to recover from the defendant.

Daniel E. Cook, Carlinville, has filed a forcible entry and detainer complaint against James Lindsey, Patricia Harbaugh, Milburn Lindsey and Toni Richardson, Carlinville, seeking possession of residential premises located in the 300 block of Anderson Street in Carlinville.

SMALL CLAIMS

Consumer Collection Management is suing Heather Haney, Brighton, seeking to collect $1,285.05 in allegedly unpaid medical bills. The suit seeks to collect $889.05 on behalf of Jersey Community Hospital, Jerseyville, and $396 on behalf of JCH Medical Group.

Synchrony Bank is suing Rebecca Droste, Brighton, for $1,751.92, plus interest and court costs, that the plaintiff claims is owed on an allegedly defaulted credit account.

Eagle Recovery is suing Constance and Jeff A. Niederbrach, Staunton, for $2,981.52, plus interest, court costs and attorney fees, allegedly owed for medical services provided by Community Memorial Hospital, Staunton.

Midland Funding, LLC, is suing Daryll Gunning, Carlinville, for $1,037.95, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Credit One Bank credit card account.

Discover Bank is suing Michelle Gerberding, Staunton, for $4,529.37, plus court costs, that the plaintiff claims is owed on an allegedly defaulted credit card account.

Discover Bank is suing Louis Ashby, Girard, for $5,350.32, plus court costs, that the plaintiff claims is owed on an allegedly defaulted credit card account.

Discover Bank is suing Kenneth G. Hicks, Gillespie, for $7,705.60, plus court costs, that the plaintiff claims is owed on an allegedly defaulted credit card account.

Joseph F. Boente Sons, Inc., Carlinville, is suing Keisha Pritchett, Girard, for $424.40, plus court costs, that the plaintiff claims is owed for propane.

Joseph F. Boente Sons, Inc., Carlinville, is suing Chris Carron, Carlinville, for $273.23, plus court costs, that the plaintiff claims is owed for propane.

Midland Funding is suing Lou Fisher, Medora, for $1,365.22, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Synchrony Bank/Old Navy credit card account.

FELONIES

Melisa J. Middleton, 34, Gillespie, is charged with possession of less than five grams of methamphetamine in connection with a Feb. 25 incident in Gillespie.

Lawrence W. Gettleman, 51, Bunker Hill, is charged with possession of a controlled substance in connection with a Jan. 31 incident in Bunker Hill during which he allegedly possessed less than 15 grams of a substance containing heroin.

Thomas M. Deck, 58, Carlinville, is charged with driving on a revoked driver’s license in connection with a Jan. 27 incident on Illinois Route 159 near Rust Road. The charge was elevated to a felony due to previous convictions for the same or similar offenses from Nov. 11, 1987, in Montgomery County, and June 12, 2002, and Feb. 7, 2003, in Macoupin County. In addition, Deck faces traffic charges for allegedly exceeding the posted speed limit by 15 to 20 miles per hour and operating an uninsured motor vehicle.

A traffic stop for allegedly failing to signal while changing lanes on Interstate 55 has led to felony charges being filed by the Illinois Attorney General’s office for alleged cigarette smuggling. Ricardo Perkins, 39, Chicago, is charged with unlawful transport of contraband cigarettes and possession of contraband cigarettes in connection with a March 1 incident at about 7 p.m. in the northbound lanes of Interstate 55 near mile marker 50. Authorities allegedly found about 250 cartons of cigarettes without required Illinois Cigarette Tax Stamps when State Police stopped his Ford passenger car. Perkins also faces an additional traffic charge for alleged unlawful transportation of alcohol by a driver.

MISDEMEANORS

Jonathan M. Kirkwood, 19, Benld, is charged with criminal trespass to a vehicle in connection with a Feb. 24 incident in Benld during which he allegedly operated a 2000 Ford vehicle without the authority of the vehicle’s owner.

Dustin R. Nash, 26, Moro, is charged with resisting a peace officer in connection with a Feb. 25 incident during which he allegedly refused an order from an Illinois State Police trooper to lie down on the ground to be handcuffed.

Nicholas R. Hupp, 21, Staunton, is charged with domestic battery in connection with a Feb. 25 incident in Benld during which he allegedly made contact of an insulting or provoking manner by holding his girlfriend on the floor as she was trying to leave the residence.

Jonah M. Niehaus, 18, Mount Olive, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with a Feb. 14 incident at about 11:30 p.m. on North Walnut Street at Main Street in Mount Olive.

Alex Meyers, 18, Gillespie, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with a Feb. 22 incident in Gillespie.

Melanie Destatte, 20, Gillespie, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with a Feb. 22 incident in Gillespie.

TRAFFIC

Chandra A. Bosler, 27, Hillsboro, is charged with two counts of driving under the influence of alcohol in connection with a Feb. 27 incident at about 9 p.m. on Second Street at Wilson Street in Gillespie. She also faces a traffic charge for allegedly driving on a suspended driver’s license.

Whitney Y. Dworzynski, 22, Carlinville, is charged with driving under the influence of alcohol in connection with a Feb. 25 incident at about 2:30 a.m. on Shipman Blacktop, Carlinville. In addition, she faces a traffic charge for alleged improper lane usage.

Samme L. Cole, 39, Carlinville, is charged with two counts of driving under the influence of alcohol in connection with a Feb. 25 incident at about 7:35 p.m. on North Oak Street at Mounds Street in Carlinville. Cole also faces a traffic charge for alleged improper lane usage.

James P. Clausen, 50, Florissant, Mo., is charged with driving under the influence of alcohol in connection with a Feb. 21 incident at about 6:24 p.m. in the southbound lanes of Interstate 55 near mile marker 45. Clausen also was cited for allegedly speeding 11 to 14 miles per hour in excess of the posted speed limit.

Richard T. Knobba, 50, St. Charles, Mo., is charged with two counts of driving under the influence of alcohol in connection with a March 5 incident at about 10:50 p.m. on Washington Street at Franklin Street in Bunker Hill. In addition, Knobba faces traffic charges for allegedly operating an uninsured motor vehicle, unlawfully transporting alcohol and speeding one to 10 miles per hour in excess of the posted speed limit.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
