LAWSUITS
Jeff Moss, Edwardsville, has filed a forcible entry and detainer complaint against Jane Bodah, Carlinville, seeking $950 in alleged unpaid rent, plus possession of a residential apartment located in the 300 block of Hickory Street in Carlinville.
A Brighton woman is suing AT&T in Macoupin County Circuit Court, claiming the communications giant has trespassed on 13 acres of farmland she owns on the west side of Brighton. The complaint, filed by Donna Schlief, seeks a court order requiring AT&T to remove utility poles and buried utilities she claims the defendant installed on her land without an easement. The suit also claims the utility’s installations have interfered with the plaintiff’s ability to farm the property as cropland. In addition to a court order requiring AT&T to remove the structures, the suit also seeks an unspecified amount of both actual and punitive monetary damages, and an award of an easement fee to Schlief for the amount of time AT&T allegedly has used her property. Schlief claims to have repeatedly notified AT&T of the alleged trespass, and to have sent a certified letter to the company on Jan. 13. The suit says she later followed up on her request via counsel and was given a phone number for AT&T’s registered agent for process service instead of an answer to her inquiry. The suit demands a jury trial.
SMALL CLAIMS
Consumer Collection Management, Maryland Heights, Mo., is suing Terry Joe McElroy, Virden, for a total of $1,286.05, plus court costs. The amount sought includes $1,149.41 allegedly owed to Carlinville Area Hospital and $134.64 allegedly owed to Macoupin Family Practice Centers.
Carlinville Area Hospital is suing William and Mae Ermadene Howland, Carlinville, for $2,226.30, plus court costs, allegedly owed for medical services.
Portfolio Recovery Associates, LLC, is suing Card D. Rodney, Alton, for $6,721.21, plus court costs, that the plaintiff claims is owed on an allegedly defaulted U.S. National Bank Association Visa credit card account.
Midland Funding, LLC, is suing Jordan Five, Carlinville, for $900, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Citibank credit card account.
Capital One Bank is suing Michael E. Dell, Brighton, for $3,385.48, plus court costs, that the plaintiff claims is owed on an allegedly defaulted credit card account.
Bari L. Phipps, Carlinville, is suing Joshua R. Boehmke, Gillespie, for $933.17, plus court costs, that the plaintiff claims he is owed for damages to his vehicle as a result of a Sept. 1, 2016, traffic accident in Carlinville.
Cavalry SPV I, LLC, is suing Kacey L. Morrison, Carlinville, for $4,929.71, plus court cost, that the plaintiff claims is owed on an allegedly defaulted credit card account.
FELONIES
Bradley E. Flowers, 45, Auburn, is charged with two counts of aggravated battery in connection with a March 18 incident in Virden during which he allegedly caused bodily harm to two Virden police officers by grabbing one officer by his face and striking the other officer in the arm with his fist.
Allan M. Springman, 33, Carlinville, is charged with possession of a controlled substance in connection with a Jan. 25 incident in Carlinville during which he allegedly possessed less than 15 grams of a substance containing cocaine.
Takedo M. Harbaugh, 19, Carlinville, is charged with burglary and criminal damage to property in connection with a March 21 incident in Carlinville during which she allegedly entered the Plaza Laundromat in Carlinville without authority and with the intent to commit a theft, and allegedly caused less than $500 in damage to a coin machine inside the business.
Cody W. Gum, 24, San Jose, Ill., is charged with possession of cannabis with the intent to deliver and possession of 30 to 500 grams of a substance containing cannabis in connection with a March 27 on North West Street at West First North Street in Carlinville. In addition to the felony charges, Gum faces traffic charges for allegedly driving on a suspend driver’s license and operating an uninsured motor vehicle.
Dominique M. Kierbach, 18, Benld, is charged with possession of methamphetamine and possession of drug paraphernalia in connection with a March 21 incident in Benld during which she allegedly possessed less than five grams of methamphetamine and a glass pipe intended to be used to inhale methamphetamine.
Dawn M. Hughes-Sanders, 45, Carlinville, is charged with possession of less than five grams of methamphetamine in connection with a March 23 incident in Carlinville.
Clement P. Serrano, 25, Carlinville, is charged with violating a no stalking/no contact order in connection with a March 22 incident during which he allegedly sent a video message to a female subject to a no stalking/no contact order issued by Macoupin County Circuit Court on Dec. 23, 2013.
Sarah M. Goodman, 36, Springfield, is charged with possession of less than five grams of methamphetamine in connection with a Jan. 11 incident.
In separate cases, Marybeth Nmi Koniak, 47, Staunton, is charged with two counts of driving on a revoked driver’s license. Koniak is accused of driving a 2003 Oldsmobile sedan on Illinois Route 4 in Staunton on March 9 and driving the same vehicle on Bunker Hill Road in Staunton on March 12 at a time when her license to drive was revoked. The charges were elevated to felonies due to previous convictions on Koniak’s record for the same or similar offense on Oct. 9, 1992, and Oct. 24, 2000, in Macoupin County.
Brian D. Raynor, 39, Edwardsville, is charged with burglary in connection with an Aug. 11, 2016, incident during which he allegedly entered a building at the Staunton Country Club without authority and with the intent to commit a theft.
MISDEMEANORS
Undray L. Bowie, 48, Milwaukee, Wis., is charged with unlawful display of a license plate in connection with a March 17 incident at about 11:34 p.m. in the southbound lanes of Interstate 55 near mile marker 48. Bowie is accused of driving a van with license plates affixed that were actually registered to a Honda Accord. In addition, he faces traffic charges for allegedly driving on a suspended driver’s license, alleged improper use of registration and alleged speeding one to 10 miles per hour in excess of the posted speed limit.
Jim Wallace, 47, Staunton, is charged with domestic battery in connection with a March 23 incident in Staunton during which he allegedly caused bodily harm by pushing a female member of her household to the ground, causing her to sustain lacerations to her elbow.
Dean P. Weller, 26, Carlinville, is charged with resisting a peace officer in connection with a March 22 incident in Carlinville during which he allegedly laid on his hands and refused to put them behind his back when ordered to do so by a Carlinville police officer.
Molly N. Hintz, 20, Lake Villa, is charged with possession of cannabis and possession of drug paraphernalia in connection with a Jan. 8 incident during which she allegedly possessed 10 to 30 grams of a substance containing cannabis and a pipe used for smoking marijuana,
Raymond R. Fields, 39, Gillespie, is charged with criminal trespass to property in connection with a March 20 incident during which he allegedly entered onto property of Macoupin County Housing Authority in the 500 block of Lynn Street, Gillespie, after receiving a “no trespassing” notice from the property owner.
Kyle M. Sellers, 20, Benld, is charged with criminal damage to property in connection with a March 9 incident in Benld during which he allegedly caused less than $500 to a window without the consent of the owner.
Kaitlyn M. Brockmiller, 18, Carlinville, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with a March 24 incident.
David L. Shapiro, 65, Hettick, is charged with criminal damage to property in connection with a July 17, 2016, incident during which he allegedly caused less than $500 in damage to road patch belonging to the Village of Hettick without the consent of the owner.
TRAFFIC
David K. Ebersohl, 43, Auburn, is charged with driving under the influence of alcohol in connection with a March 18 incident in Virden. Ebersohl also faces a traffic charge for alleged improper lane usage.
Christopher J. Smith, 53, East Alton, is charged with driving under the influence of alcohol in connection with a March 12 incident at about 10:30 p.m. on West Main Street in Carlinville. He also faces a traffic charge for allegedly operating a vehicle with an expired registration.
Christopher S. Cox, 41, Mount Olive, is charged with two counts of driving under the influence of alcohol in connection with a March 18 incident on Illinois Route 16 near Hornsby Road. Cox also faces traffic charges for allegedly driving on a suspended driver’s license, operating an uninsured motor vehicle and improper lane usage.
Tracy J. Parga, 36, Springfield, is charged with driving under the influence of alcohol in connection with a March 18 incident at about 1:54 a.m. on North Third Street at West Central Street in Girard. He also is charged with speeding 11 to 14 miles per hour in excess of the posted speed limit.
Jeffrey C. Marcum, 24, Brighton, is charged with two counts of driving under the influence of alcohol in connection with March 20 incident at about 2:53 a.m. on South Maple Street north of Jersey Street in Brighton.
Kamryn A. Baker, 22, Palmyra, is charged with two counts of driving under the influence of alcohol in connection with a March 18 incident at about 5 a.m. on Illinois Route 111 at the north edge of Chesterfield. He also faces a traffic charge for alleged improper parking on a roadway.

Staunton man found guilty of criminal sexual assault

BenGil StaffA verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.
Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.
The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.
Sentencing for Dehart Jr. is set for October 4, 2023.
