LAWSUITS

A Bunker Hill woman is suing Great American Insurance Group for more than $122,000, claiming the company wrongfully denied a legitimate claim. In the suit, Betty Phelps claims she was the owner of property in the 100 block of North Washington Street, Bunker Hill, where she operated a fitness gym where clients could use various pieces of exercise equipment. On June 14, 2014, according to the suit, the property was extensively damaged as a result of a fire in an adjourning building. Phelps filed claim with her insurance company, Pekin Insurance, which subsequently cancelled her policy, the suit claims. At the time, the property was mortgaged to United Community Bank, Bunker Hill, in the amount of about $98,000, the suit claims. United Community Bank required Phelps to maintain casualty insurance on the property, but Phelps was unable to arrange for alternate insurance coverage. As a result, United Community Bank arranged for “forced” coverage through its own insurer, Great American Insurance Group, with the bank as the primary beneficiary and Phelps as a third party beneficiary. According to the suit, Phelps paid $2,289 in premiums for the “forced” insurance coverage. According to the suit, in January 2016, before Phelps could make repairs from the first fire, a second fire in the building to the south of her property caused additional damage. An insurance appraiser set the value of the damage at $119,660. A short time later, the City of Bunker Hill issued a Notice of Nuisance for the fire-damaged property to the south of Phelps’s building and secured an Emergency Order of Demolition on Feb. 20, 2016. Because Phelps’s property and the property to the south shared a wall, Phelps’s property also was demolished, causing her to incur demolition costs of $19,400, and leaving her with a debt of $97,400 to United Community Bank for a building that no longer exists, the suit alleges. Through her attorney, Phelps submitted a letter to Great American Insurance offering to accept a settlement of $48,500—approximately half of what is owed on the mortgage, the suit claims. Great American Insurance reportedly denied the claim, claiming that the value of items lost amounted to about $682 and did not meet the policy’s $1,000 deductible amount. Count I of the suit claims Great American Insurance breached its contract with Phelps by failing to pay the full amount of the claim and asks for a judgment of $97,400, plus interest, attorney fees and court costs. Count II seeks punitive damages of an additional $25,000, claiming the company’s denial of Phelps’s claim was unreasonable and vexatious. The suit demands a jury trial.

Jasmina Silic, White City, has filed a forcible entry and detainer complaint against Derek School, White City, claiming she is entitled to possession of residential premises located in the 300 block of Fourth Street in White City.

Chesterfield State Bank is suing Janet Kroeschel, Chesterfield, to collect on two promissory notes the bank claims are in default. Count I of the suit seeks damages in the amount of $6,584.39 and $893.73 in interest, plus additional interest, attorney fees and court costs, that the plaintiff claims is owed on a $10,000 note executed on Oct. 10, 2012. Count II seeks $8,602.33 and $667.18 in interest, along with additional interest, attorney fees and court costs, that the plaintiff claims is owed on a $10,000 note executed on Aug. 6, 2014. Both notes have been in default since Nov. 2, 2015, according to the suit.

SMALL CLAIMS

Capital One Bank is suing Molly A. Clayton, Carlinville, for $3,601.58, plus court costs, that the plaintiff claims is owed on an allegedly defaulted credit card account.

Credit Acceptance Corp is suing Gina M. Long, Waverly, for $9,974.85, plus court costs, that the plaintiff claims is owed on a defaulted $11,972.95 auto loan executed March 13, 2015, for the purchase of a 2007 Pontiac G6 sedan from Freedom Chevrolet, Virden.

Max B. Mullins Landscaping, Staunton, is suing Bauman Property Co., Springfield, Mo., for $9,200 that the plaintiff claims is owed for landscaping services.

FELONIES

In separate charges, Joshua S. Dyer, 39, Effingham, and Jennie R. Hudgins, 40, Irving, are charged with criminal trespass to property and criminal damage to property in connection with an April 13 incident in Girard, during which they allegedly entered a residence in the 200 block of South Fifth Street in Girard without authority, and caused more than $500 in damage to a door at the residence. In addition, Hudgins is charged with obstructing a peace office for allegedly running away from a Girard police office as he attempted to place her under arrest.

Andrew L. Lattina, 23, Staunton, is charged with failing to register as a sex offender for allegedly failing to register with the Staunton Police Department within three days of establishing a new place of residence in Staunton. Lattina apparently was cited after the vehicle he was driving was stopped by police on April 15 in Staunton for allegedly driving on a suspended driver’s license.

Perry Ashby, 47, Girard, is charged with possession of than five grams of methamphetamine in connection with an April 15 incident in Gillespie.

Brandon D. Butler, 29, Bunker Hill, is charged with aggravated assault in connection with an April 17 incident in Bunker Hill during which he allegedly attempted to kick a Bunker Hill police officer in the head while the officer was engaged in the execution of his official duties.

Zachariah M. Schmidt, 19, Carlinville, is charged with having sexual relations within his family in connection with an April 17 incident in Carlinville during which he allegedly engaged in sexual intercourse with a female member of his family.

Patricia G. Harbaugh, 38, Carlinville, is charged with burglary in connection with an April 18 incident in Carlinville during which she allegedly entered a 1996 Chevrolet mini-van without the authority of its owner with the intent to commit a theft.

Ronald O. Lloyd, 50, Litchfield, is charged with possession of less than five grams of methamphetamine in connection with an April 21 incident in Staunton.

MISDEMEANORS

Denyse D. Greff, 47, Virden, is charged with domestic battery involving bodily harm in connection with an April 14 incident.

Chandra A. Bosler, 27, Hillsboro, is charged with battery in connection with an April 16 incident in Gillespie during which she allegedly struck a female victim in the face, causing bodily harm.

Michael T. Mitchusson, 24, Gillespie is charged with domestic battery and resisting a peace officer in connection with an April 19 incident in Gillespie.

Brittany D. Daniels, 26, Carrollton, is charged with obstructing identification in connection with an Oct. 20, 2016, incident during which she allegedly provided a false name to a Brighton police officer who had lawfully detained her.

Kevin L. Morgan, 33, Carlinville, is charged with violating an order of protection in connection with an April 5 incident during which he allegedly entered onto property in the 200 block of Rice Street in Carlinville in violation of a protection order issued by the court on April 3.

Nick L. Hollis, 54, Gillespie, is charged with battery in connection with an April 17 incident in Gillespie during which he allegedly struck a male victim in the face with his fist, causing bodily harm.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
