LAWSUITS

Judgment was entered Oct. 24 in a forcible entry and detainer complaint filed by Linda Mahan, Girard, against Patrick and Machelle Martin, Virden, seeking $4,700 in alleged unpaid rent, plus damages, court costs, attorney fees and possession of residential premises located in the 200 block of North Church Street in Virden.

Heather and Tyler Washburn have filed a forcible entry and detainer complaint against Dillard DeHart, Gillespie, seeking $950 in alleged unpaid rent, plus late fees, court costs, attorney fees and possession of residential premises located in the 600 block of Charles Street in Gillespie.

Susan Y. and Jacke L. Goldbricht, Carlinville, have filed a forcible entry and detainer complaint against Brandon Goldbricht and Chelsea Mueller, Carlinville, seeking possession of a residential apartment located in the 200 block of North Charles Street in Carlinville.

First MidAmerica Credit Union is suing Allen Young, Mount Olive, for $11,777.35, plus interest of 9.96 percent from July forward, attorney fees and court costs that the plaintiff claims is owed on a Visa credit card account that allegedly went into default as of April 19.

R & P Fugate Rentals, LLC, has filed a forcible entry and detainer complaint against Derrick Courier, Girard, seeking $1,075 in alleged unpaid rent, plus late fees, attorney fees, court costs and possession of a residential apartment located in the 100 block of Center Street in Girard.

SMALL CLAIMS

Steve and Charlene Baugh, Bunker Hill, are suing Ronnie D. Harville, Bunker Hill, for $664.40, claiming that two dogs owned by Harville got loose and attacked a cat belonging to the plaintiffs. The judgment sought includes $427.40 for emergency veterinarian care and euthanasia, court costs, mileage and the cost of a replacement cat.

First MidAmerica Credit Union is suing Robert P. Edwards, Benld, for $9,384.69, plus 2.99 percent in interest from Sept. 27 forward, court costs and attorney fees that the plaintiff claims is owed on an allegedly defaulted installment loan for $30, 888 executed May 19, 2015, for the purchase of a 2012 Buick LaCrosse. The judgment sought represents an alleged deficiency remaining after the vehicle was repossessed in July and sold at auction.

FELONIES

Dustin Luketich, 28, Gillespie, is charged with possession of less than five grams of methamphetamine in connection with an Oct. 16 incident in Gillespie.

Michael A. Clendenen, 19, Dow, is charged with possession of a controlled substance in connection with a Sept. 16 incident in Bunker Hill during which he allegedly possessed an unspecified quantity of a substance containing Alprazolam.

Kyle R. Kessler, 31, Wilsonville, is charged with aggravated battery in connection with an Oct. 20 incident in Benld during which he allegedly threw a pocket knife at a female victim while she was in front of the Benld Police Department, a public place, striking the victim in her left shoulder.

Robert C. Farris, 59, Staunton, is charged with aggravated assault in connection with an Oct. 22 incident in Staunton during which he allegedly “bumped chests” with and yelled obscenities at a Staunton police officer while knowing the victim to be a peace officer engaged in the execution of his official duties.

Alex M. Baldwin, 20, Brighton, is charged with aggravated battery in connection with an Oct. 20 incident during which he allegedly punched a male victim in the face, causing a laceration over the victim’s left eye, while at the Bunker Hill Short Stop, a public place.

Carrington Saggio, 26, Benld, is charged with possession of a controlled substance in connection with an Oct. 23 incident at about 5:38 p.m. on Illinois Route 4 at Mount Clare Drive during which he allegedly possessed less than 15 grams of a controlled substance. In addition, Saggio is charged with driving under the influence of alcohol and improper parking on a roadway in connection with the same incident.

Dustin M. Luketich, 28, Gillespie, is charged with possession of a stolen firearm in connection with an Oct. 3 incident during which he allegedly possessed a Smith and Wesson .38 Special while knowing the gun to have been stolen.

MISDEMEANORS

Kevin S. Welden, 50, Greenfield, is charged with battery in connection with an Oct. 16 incident during which he allegedly caused bodily harm when he “poked” a female victim, causing her to fall to the ground.

Donald E. Ruyle, 44, Benld, is charged with domestic battery in connection with an Oct. 15 incident during which he allegedly caused bodily harm by striking his wife in her head with his fist.

Jasen R. Ferratto, 27, Benld, is charged with disorderly conduct in connection with an Oct. 11 incident in Carlinville during which he allegedly pounded on the door of a woman’s residence and tried to enter the residence in such an unreasonable manner as to alarm and disturb the victim and provoke a breach of the peace.

Vernon E. Haustein 30, Staunton, is charged with domestic battery in connection with an Oct. 22 incident during which he allegedly caused bodily harm by striking his girlfriend in her head with his fist.

Quentin A. Drew, 38, Girard, is charged with domestic battery in connection with an Oct. 22 incident during which he allegedly caused bodily harm by throwing his wife to the ground and then striking her in her face.

Matthew W. Stoops, 26, Woodburn, is charged to criminal trespass to real property in connection with an Oct. 20 incident during which he allegedly entered onto a property in the 1100 block of East Macoupin Street in Staunton after having received prior notice that such entry was forbidden.

Bryce A. DeSpain, 20, Carlinville, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with an Oct. 21 incident at about 11:25 a.m. at the intersection of Litchfield Road and Bierman Road.

Dennis E. Tucker, 39, Shipman, is charged with theft in connection with an April 28 incident during which he allegedly obtained control over stolen motorcycle parts valued at less than $500 under circumstances that should have caused the defendant to believe they were stolen and with the intent to permanently deprive the rightful owner of the property.

William G. Howard, 30, Springfield, is charged with domestic battery in connection with an Oct. 26 incident in Carlinville during which he allegedly struck his girlfriend in her head with his fists.

TRAFFIC

Chris L. Smith, 35, Bunker Hill, is charged with driving under the influence of alcohol in connection with an Oct. 22 incident at about 12:16 a.m. on West Warren Street at Foote Street in Bunker Hill. In addition, Smith faces traffic charges for alleged improper lane usage, illegal transportation of alcohol by a driver, operation of an uninsured motor vehicle, failure to carry a driver’s license on his person, disregarding a traffic control device, speeding 15 to 20 miles per hour in excess of the posted speed limit and failing to drive on the right side of the road.

Dustin E. Libbra, 29, Gillespie, is charged with two counts of driving under the influence of alcohol in connection with an Oct. 20 incident at about 9:05 p.m. at the intersection of Illinois Route 16 and Western Avenue in Gillespie. In addition, Libbra faces traffic charges for alleged operation of an uninsured motor vehicle and improper traffic lane usage.

Randall W. Bersch, 37, Mount Olive, is charged with two counts of driving under the influence of alcohol in connection with an Oct. 20 incident at about 3:12 a.m. on Maple Street at Mill Street in Staunton. Bersch also faces traffic charges for alleged illegal transportation of alcohol by a driver and disregarding a traffic control device.

Staunton man found guilty of criminal sexual assault

A verdict was rendered on Tuesday in about 35 minutes for a Staunton man who was found guilty of criminal sexual assault.

Dillard Dehart Jr., 66 of Staunton, was charged with the offense on February 17, 2022, after his niece had accused him of the offense and had secretly recorded parts of the offense.

The secretly recorded videos were played for the jury, according to Macoupin County State’s Attorney Jordan Garrison who called multiple witnesses and tried the case.

Sentencing for Dehart Jr. is set for October 4, 2023.
