LAWSUITS
Caterpillar Financial Services, Inc., headquartered in Nashville, Tenn., has filed a complaint in replevin seeking a court order to take possession of more than $200,000 worth of equipment from a Hettick bulldozing company. Named as defendants are Jackson Bulldozing and Excavating, Inc., company owner Benjamin K. Jackson, Hettick, and Lisa McMullan, also of Hettick, who allegedly signed as personal guarantor for a portion of the company’s indebtedness to the plaintiff. The suit seeks a court order for the plaintiff to recover a Caterpillar D6RIII track type tractor with an estimated value of $79,200, a Caterpillar 320D6 hydraulic excavator estimated to be worth $46,700, a 2011 Caterpillar 402F backhoe loader estimated to be worth $42,000 and a Caterpillar 305ECR hydraulic excavator with an estimated worth of $38,400. According to the suit, Jackson Bulldozing entered into an installment loan to purchase the 420F backhoe loader in September 2015 and later entered into an installment loan agreement to purchase the 305ECR hydraulic excavator in April 2016. The company allegedly pledged the additional equipment to secure the loan as part of a cross collateral/cross default agreement at the time of the September 2015 purchase. At the same, both Jackson and McMullan allegedly committed themselves contractually as personal guarantors for the debt. Caterpillar Financial now claims the loans are $28,585.35 in arrears and that the defendants owe a total of $189,096.38 to satisfy the debt. The five-count lawsuit seeks a court order authorizing the plaintiff to take possession of the equipment and sell it at auction to satisfy the debt, a court order making the defendants responsible for any deficiency remaining after proceeds of the sale are applied to the debt, and a breach of contract judgment holding the defendants responsible for the cost of taking possession of the equipment, transporting it and liquidating it, along with costs of the lawsuit and any other amounts due or becoming due to the plaintiff.
Consumer Collection Management is suing Jeff and Teresa Evans, Carlinville, for a total of $14,585.17, plus court costs, the plaintiff claims is owed for medical services. The plaintiff seeks to collect $14,585.17 on behalf of Carlinville Area Hospital and $680 that allegedly was owed to Macoupin Family Practice Centers.
Bank of America is suing Sheri L. Steward, Bunker Hill, for $15,196.70, plus court costs, that the plaintiff claims is owed on an allegedly defaulted credit card account.
Jessie Wallace, Girard, has filed a forcible entry and detainer complaint against Adam P. Wallace, Virden, seeking $4,800 in alleged unpaid rent, plus court costs and possession of residential premises located in the 600 block of Carey Street in Virden.
Lewis Hancock has filed a forcible entry and detainer complaint against Tara Hanner Provaznik and Jake Provaznik, Bunker Hill, seeking $2,300 in alleged unpaid rent, plus court costs, damages and possession of residential premises located in the 300 block of Washington Street in Bunker Hill.
SMALL CLAIMS
Consumer Collection Management is suing Stacey D. Lawson, Medora, for a total of $1,701.87, plus court cost, that the plaintiff claims is owed for medical services. The judgment sought includes $1,581.87 allegedly owed to Jersey Community Hospital and $120 allegedly owed to SLU-Care.
Consumer Collection Management is suing Craig E. and Linda Niehaus, Staunton, for a total of $1,297.48, plus court costs, that the plaintiff claims is owed for medical services. The amount sought includes $1,159.88 allegedly owed to St. John’s Hospital and $137.57 allegedly owed to SLU-Care.
Carlinville Area Hospital is suing Tracy Lynn Mitchusson, Virden, for $4,526, plus court costs, that the plaintiff claims is owed for medical services.
Height Finance Corporation is suing Allan and Teresa Williams, Staunton, for $952.84, plus court costs, that the plaintiff claims is owed on an allegedly defaulted consumer loan for $1,839.25 executed in March 2015 at an interest rate of 35.51 percent.
Jefferson Capital Systems is suing Tammy L. Pollard, Gillespie, for $1,013.83, plus court costs, that the plaintiff claims is owed on an allegedly defaulted WebBank credit card account.
Portfolio Recovery Associates is suing Nathan Peeler, Virden, for $616.50, plus court costs, that the plaintiff claims is owed on an allegedly defaulted Synchrony Bank credit card account.
FELONIES
Warren E. Copeland, 32, Cottage Hills, is charged with two counts of possessing a stolen vehicle in connection with a Feb. 2 incident during which he allegedly was found to be in possession of a 2016 Chevrolet Silverado that he knew to be stolen from Bruckert Daley Chevrolet, Carlinville, and a 2012 Ford F-150 that he knew to be stolen from a Carlinville man.
Andrea M. Register, 32, Virden, is charged with possession of less than five grams of methamphetamine in connection with a Feb. 22 incident in Carlinville. Register also faces a traffic charge for allegedly operating an uninsured motor vehicle.
Austin J. Fanning, 23, Carlinville is charged with possession of less than five grams of methamphetamine in connection with a Feb. 19 incident in Carlinville.
Eric Damm, 28, Palmyra, is charged with obstructing justice in connection with a Jan. 22 incident during which he allegedly provided false information to a Macoupin County Sheriff’s deputy about the whereabouts of a pink Ruger LCP .380 handgun that was evidence in a theft investigation. Earlier this year, Damm was charged with theft two counts of criminal damage to property in connection with a Jan. 21 incident in Palmyra during which he allegedly caused extensive damage to a Palmyra residence by driving a vehicle through a garage door and punching out a window, and exerting unauthorized control over the pink handgun belonging to the resident with the intent to permanently deprive the owner of the use of the property.
MISDEMEANORS
Alyssa N. Kilian, 23, Carlinville, is charged with domestic battery in connection with a Jan. 19 incident in Carlinville during which she allegedly caused bodily harm to a female member of her household by slapping the victim in her face with an open hand.
Christopher M. Ogden, 22, Plainview, is charged with criminal trespass to a motor vehicle in connection with a Feb. 21 incident during which he allegedly operated a 1996 Buick sedan without the permission of the vehicle’s owner.
Earl T. Brown, 45, Benld, is charged with violating an order of protection in connection with a Feb. 17 incident during which he allegedly sent a text message to a female who was subject to a Feb. 6 court order of protection against him.
Janice E. McGhee, 45, Hamel, is charged with deceptive practice for allegedly writing a check on Oct. 23, 2016, for $105.35 to Bill’s IGA while knowing her bank would not honor the draft.
Shane J. Lomelino, 29, Palmyra, is charged with domestic battery in connection with a Feb. 20 incident during which he allegedly caused bodily harm to his girlfriend by striking her in the jaw with his closed fist.
Sebastion S. Nessl, 22, Mount Olive, is charged with domestic battery in connection with a Feb. 22 incident during which he allegedly made contact of an insulting or provoking nature when he grabbed a male member of his household by the throat.
Diahnte K. Garret, 22, Chicago, is charged with possession of 10 to 30 grams of cannabis in connection with a Feb. 5 incident.
Christina G. Harbaugh, 39, Carlinville, is charged with the unlawful sale of tobacco to a minor in connection with a Feb. 11 incident at Casey’s General Store in Carlinville.
James D. Gipson, 18, Mount Olive, is charged with unlawful consumption of alcohol by a person under the age of 21 in connection with a Feb. 20 incident on Honey Creek Road at Franke Road.
Edward C. Heidenreich, 33, Springfield is charged violating provisions of the state’s concealed carry act by carrying a concealed firearm while under the influence of alcohol in connection with a Jan. 29 incident on North Broad Street at West First North Street in Carlinville. at about 12:24 a.m. Heidenreich also is charged with two counts of driving under the influence of alcohol and operating a vehicle with a faulty registration light.
TRAFFIC
Dustin R. Nash, 26, Moro, is charged with driving under the influence of alcohol in connection with a Feb. 25 incident.
Joel W. Clock, 32, Bunker Hill, is charged with driving under the influence of alcohol in connection with a Feb. 24 incident. Additionally, Klocke faces traffic charges for alleged reckless driving, leaving the scene of an accident, operation of an uninsured motor vehicle, failure to reduce the speed of his vehicle to avoid an accident and unlawful transportation of alcohol by a driver.

Macoupin County Clerk, Recorder & Elections Office temporarily relocating due to courthouse renovations

The Macoupin County Clerk, Recorder, and Elections Office will temporarily relocate across the street to the Macoupin County Voting Center, located at 227 E. First South in Carlinville, beginning Tuesday, November 18, 2025.
The move is necessary to accommodate HVAC system renovations in the Macoupin County Courthouse. The temporary relocation is expected to last until mid-January 2026.
During this time, all regular services — including vital records, recordings, elections, and general clerk functions — will continue to be available at the Voting Center. Office hours and contact information will remain the same.
However, due to limited space during the renovation, public searching and certain in-person services may be restricted. Residents are encouraged to take advantage of the many online services offered through the Clerk’s website, including:
- Searching and ordering vital records
- Accessing property and land records
- Viewing election information and forms
- Checking registration and voter status
“We appreciate everyone’s patience as we make these necessary improvements to the Courthouse,” said Macoupin County Clerk Pete Duncan. “Our goal is to continue serving the public efficiently and safely, whether in person or online.”
