LAWSUITS
In separate complaints, Debbie M. Osborn is suing Seneca Companies, Inc. and Seneca Tank for unspecified damages in excess of $5,000 but less than $50,000 for the use and benefit of Casey’s General Stores, Inc. The suits were filed under provisions of the Illinois Workers Compensation Act to reimburse Casey’s for workers compensation payments made to Osborn as a result of injuries she sustained while working at the Benld Casey’s store. The allegations and damages sought are identical in both suits and both suits demand jury trials. According to the suits, the defendants were contracted to install fuel pumps at the store and had run an extension cord from the building to the fuel pump island on Nov 3, 2015, the date Osborn allegedly tripped and fell at the store. The suit alleges the defendants run the extension cord across the sidewalk, walkway and parking lot to the fuel pump islands, causing Osborn to trip and fall while carrying trash to an outside dumpster and injuring her right arm and elbow. The suit claims the defendants were negligent in failing to cover the extension cord to prevent trips and falls, failing to provide notice of the hazard by placing signs or cones in the area, failing to exercise reasonable care in performance of their work, failing to provide safe ingress and egress to the store, and failing to maintain a safe working environment. The suit claims Casey’s has already expended more than $5,000 in workers compensation payments and benefits to Osborn and expects to make additional payments to compensate Osborn for her injuries, pain and suffering and medical expenses.
