LAWSUITS

Amanda Ratcliffe, Bunker Hill, is suing Daniel Komnick, also of Bunker Hill, for damages in excess of $50,000 for injuries she allegedly sustained in a traffic crash involving the vehicle she was driving and a tractor Komnick was operating in May 2016. According to the suit, the crash occurred when Ratcliffe, driving a southbound 2008 Pontiac Grand Prix, attempted to pass a 2000 John Deere tractor operated by Komnick on May 25, 2016, on Illinois Route 159 near its intersection with Downtha Lane. As Ratcliffe was passing the tractor, Komnick allegedly made a left turn without signaling, resulting in a collision involving the two vehicles. Ratcliffe claims to have sustained injuries to her back, neck, head and knee as a result of the crash. The suit alleges Komnick was negligent in allegedly failing to signal before making a left turn, failing to use the lights on his tractor, failing to make sure the roadway was clear before making a left turn and failing to keep a proper lookout for other vehicles. Ratcliffe seeks monetary damages for her alleged injuries, pain and suffering, loss of a normal life and medical expenses.

A 74-year-old Bunker Hill woman is suing her 54-year son for damages in excess of $50,000, claiming her son unlawfully interfered in a real estate transaction. In addition, the suit seeks injunctive relief against the defendant, claiming he threatened his mother’s life and that of his sister. The suit, brought by Diane F. Schwinn, names Keith A. Schwinn of Caseyville as the defendant. According to the suit, the defendant allegedly assisted his father, William J. Schwinn, Jr., with construction work at the family’s residence in the 200 block of Schwinn Lane, Bunker Hill, presumably on a voluntary basis to assist his parents. The suit alleges, however, that Keith Schwinn later filed a mechanics lien against the property but did not file an action to foreclose on the lien. Prior to his father’s death on Jan. 14 this year, Keith Schwinn gave his parents a release of lien, according to the suit, but reinstated a lien on Oct. 25 this year. The suit claims Diane Schwinn entered into a real estate sales contract to sell the residence for $199,000. The buyer reportedly withdrew from the contract, however, because of the lien. The suit alleges the plaintiff incurred a loss of profits and incurred continuing fees and expenses for taxes, upkeep and maintenance because of the “defendant’s actions and purported lien that was released.” Count I of the suit seeks monetary damages in excess of $50,000 for the plaintiff’s alleged financial losses. Count II of the suit seeks injunctive relief, asking the court to impose a temporary restraining order, and a preliminary and/or permanent injunction against the defendant. The second count of the suit alleges that Keith Schwinn has harassed and threatened the plaintiff, threatening to “get his gun and kill” her. The suit claims the defendant also indicated he wanted his mother to “suffer” and that he would “put a bullet in his sister’s, Mary A. Basden, head” instead of killing his mother. Count II further alleges the defendant “caused to be filed a purported lien” several years after his first lien was waived.

The seventh-grade Gillespie Indians win the regional championship by defeating Staunton, 25-6.

The Gillespie Middle School basketball program continued its success once again with a regional championship victory last week where the Indians advanced to the sectionals with a 25-6 victory over Staunton.

After receiving a bye to start the regional tournament that was played at Ben-Gil Elementary School, the Indians (1st seed) advanced to the regional championship with a 30-23 victory over Southwestern. Gillespie met Staunton (2nd seed) in the regional championship, but quickly secured the lead and the game.

The Indians allowed Staunton no points in the first quarter as they built a 6-0 lead after the first quarter, but then only scored two points in the second quarter for a halftime score of 8-4. After regrouping at halftime, Gillespie added 12 points to their score in the third quarter and led the Terriers 20-6 heading into the fourth quarter.

Gillespie again prevented Staunton from scoring in the fourth quarter while adding five points to their own score to finish the game with a 25-6 victory.

Emily Schoen led the Indians with 11 points while Addie Hayes and Regan Bussmann each scored six points for Gillespie.

The Indians will now face Pana in the Vandalia Sectional on Wednesday, Nov. 29 at 6:30 p.m. The game will be played at Vandalia Junior High School. Pana was also the top seed in their regional and defeated Girard North Mac 22-5 in the regional semi-finals and Litchfield 26-23 to win their respected regional.

In the last two years, GMS has brought home four top finishes from the IESA State Tournament. In 2015, the seventh-grade boys finished first in state while the girls finished second and then in 2016, the boys followed up with a fourth-place finish while the girls finished fourth as well.
