Business owner asks Gillespie for permit to sell fireworks
Mayor John Hicks directs the council’s attention to the final plat of the Western View Estates.
Bill Toprani, owner the Village of Toy Chest of Gillespie, requested the City of Gillespie to approve a permit or ordinance during the regular business meeting on February 9, 2015, to allow the sales of fireworks at his establishment located at 106 South Macoupin in Gillespie.
Toprani has been a licensed firework dealer since 1997 and has sold fireworks at his Gillespie location since 2008. “I have always complied with state laws and licensing requirements regarding consumer firework sales,” he told the council. “But the state through a curve at me this year. They are requesting a permit or ordinance as a condition of my license.”
The Gillespie council posed no objections with his request other than asking him to have the fire chief review how the fireworks are stored at his location. The request from the state puts Toprani in a bind because as he noted, the sale of fireworks is vital to the store’s income.
Toprani explained the requirement from the state is being enforced to potentially restrict the number of tent sales. “The tents come in and conduct business with no business licensing and pay no sales tax,” he added. “I have nothing against tent sales, but I have a brick and mortar store, I pay sales tax and I am a fixture to the community.”
The city council told Toprani their attorney would draft an ordinance in the next 30 days and the council would review and potentially approve the draft at the next board meeting in March.
Western View Estates
Jeff Meyer with Hurst-Rosche presented the council with the final plat for the Western View Estates after the council requested Meyer provide the city’s engineer with the drainage calculations last month. Alderman Steve Kluthe said he wanted to ensure the citizens that live nearby won’t be harmed once the development is complete.
“If they build the ground higher, the water is going to be pushed further north,” Kluthe explained. Dan Fisher added, saying the storm events have been stronger the past five years, but the plans proposed meet the requirements but are very minimal in terms of standards.
Fisher asked for a committee meeting with Meyer and additional engineers. “It seems prudent,” Fisher explained. “We can have the power to act at the meeting.” The council unanimously granted the committee the power to act at the next meeting on Monday, February 23.
Meyer explained the area is low and the same issues would be in question even if people bought the land to built houses. “We aren’t going to solve all of the problems,” Meyer closed.
Old Business and New Business
The council approved a $3,747 Hach Service agreement and approved a $100 donation to Ben-Gil Elementary School’s Adopt-a-Class program.
Maintenance chairman Jerry Doliger said the city’s 2004 diesel pickup just got out of the shop again after replacing the turbo sensor. “We have spent $3,000 on this truck in the past five weeks,” Doliger explained. “It runs real good now, but we don’t run a diesel truck like it needs to be ran. What do we do with this?”
Alderman Gus Ottersburg said Jerry got ahold of the local Ford dealer with the state bid and the city could get a 4WD ¾ ton pickup truck 6.2 v8 for $23,260. “I think this truck would adequately serve the city with minimal expense,” Ottersburg closed.
Standing Committee Reports
Lake Chairman Frank Barrett reported the insurance will not cover the spillway until the problems from the dam inspection get fixed, but the repairs cannot be made until the weather clears up. “So if anything happens between now and when we get it fixed, we aren’t covered,” Mayor Hicks questioned. “Get it fixed as soon as you can.”
Alderman Gus Ottersburg said the new trailer the city bought for the water department looks great. He said the city may have to buy a couple mirrors to see behind the trailer and will have get graphics for the trailer so citizens know it is part of the city fleet.
City Treasurer Dan Fisher said the five year combined fund total signals steady growth, but the city still has to do their due diligence because there are purchases that are being discussed that are not being appropriated for. “We haven’t appropriated to buy a new truck or fix the dam,” Fisher explained. “I’m not saying we can’t afford these big ticket items, I’m just saying that is why our projection is going to come out less rosy versus our projection.”
